Since the FAA has filed a [25] Motion to Dismiss that is not within the Courts jurisdiction because the FAA is not a p arty to this action, the clerk is DIRECTED to terminate the motion [25] The clerk is also DIRECTED to terminate Michael Huerta and the Federal Aviation Administration as parties to this action. Plaintiffs [17] 18 and [30] discovery motions are DENIED as untimely. Plaintiffs [13] Emergency Motion to Appoint Counsel and Plaintiffs [19] Motion to Appoint Counsel are DENIED. Plaintiffs [21] Motion for Summary Judgment is DENIED as untimely. Plaintiffs [29] Emergency Motion for Declaratory Judgment is DENIED as MOOT.
