FOIA Activity: 15 New Procedural or Substantive Decisions

We have added 15 decisions of a procedural or substantive nature filed between November 2, 2014 and November 8, 2014. These are associated with 12 FOIA cases pending in federal district court. Note that because there can be delays between the date a decision is made and when it shows up on PACER, this listing includes only decisions that appeared on PACER during this period.

    • November 6, 2014: ORDER that The parties cross-motions for summary judgment are each GRANTED IN PART AND DENIED IN PART [27] , 31. Summary judgment is GRANTED to Plaintiff on the issue of delay; the Court finds that Defendants delays in processing Plaintiffs request and appeal constituted an independent FOIA violation. Summary judgment is GRANTED IN PART to Defendant on the issue of the exempted material. The Court will return the unredacted copies of the documents to Defendant with a separate order explaining what additional information is not exempt; the Court orders Defendant to release such information toPlaintiff by Judge Dean D.
