Dubuque v. Air Force Office of Special Investigations et al and 6 other new FOIA lawsuits

We have added 21 documents from 2 FOIA cases filed between July 24, 2016 and July 30, 2016. Note that there can be delays between the date a case is filed and when it shows up on PACER. If there are filings from this period that have yet to be posted on PACER, this FOIA Project list may not be complete.

  • Dubuque v. Air Force Office of Special Investigations et al (filed Jul 29, 2016)
    Mark Dubuque submitted a FOIA request to the Department of the Air Force and the Air Force Office of Special Investigations for records concerning, among other things, a polygraph test that Dubuque had taken. The agency did not respond and Dubuque filed suit in 2015. That suit resulted in the disclosure of 232 documents, although the agency did not release the records concerning the polygraph test and continued to assert exemptions. Dubuque and the agency apparently settled that suit with the understanding that he could continue to pursue an administrative appeal and file for attorney’s fees. This suit appears to be a result of the agency’s failure to provide more documents.

  • NATIONAL FEDERATION OF FEDERAL EMPLOYEES, FD-1, IAMAW v. UNITED STATES FOREST SERVICE (filed Jul 29, 2016)
    The National Federation of Federal Employees submitted three FOIA requests to the U.S. Forest Service. One was for travel vouchers, one was for contracts, and the third was for job descriptions. The agency acknowledged receipt of all three, but after the agency failed to respond to any of the requests, the National Federation of Federal Employees filed suit.
