FOIA Project Annotation: A federal court in Illinois has ruled that the U.S. Marshals Service conducted an adequate search in response to William Mabie's FOIA request for records pertaining to the video surveillance system at the U.S. Courthouse in East St. Louis. In response to Mabie's request for records on the installation of the video surveillance system, including the installer's notes, Eric Johnson, the agency employee responsible for maintaining the electronic security system at ESL Courthouse, searched the USMS Judicial Security Division, where I thought responsive records would be located, but found no records. He then contacted Johnson Controls, which was the company currently maintaining the video surveillance system but not the company that had updated the system in 2014. Johnson Control had no records of the installation process but was able to provide records about the system. The agency disclosed 23 records with redactions under Exemption 7(E) (investigative methods and techniques) and Exemption 7(F) (harm to a person). The court approved of the agency's search, noting that "in the absence of any contract in the USMS's contract files, Johnson reached out to the current service provider for more information. Searching outside the agency was not required by FOIA, so such a pursuit is evidence supporting the USMS's good faith in looking for responsive records." Mabie claimed that there might have be some information about the installer in security clearance records. The court rejected that claim, pointing out that "that there may exist somewhere some security clearance information about an individual worker who worked on the installation does not mean that the search conducted was inadequate."

2018-12-2757ORDER: On December 21, 2018, the Court received a "Petition for Immediate Injunctive Relief Medical Necessity" (Petition for Injunctive Relief) from Plaintiff. The Clerk of the Court docketed the pleading as a motion in the instant case (Doc. 56 ). Upon review, however, it is evident that the pleading was not appropriately filed in this case. In the instant case, Plaintiff seeks enforcement of a Freedom of Information Action request he submitted to the United States Marshals Service. The Petition for Injunctive Relief pertains to Plaintiff's medical care at the U.S. Penitentiary in Marion, Illinois and names officials working at that facility as defendants. Additionally, it does not include a case number. Instead, Plaintiff states that the case number is TBA. Considering these factors, the Court DIRECTS the Clerk of the Court to open a new case directed against UNKNOWN MEDICAL STAFF OF MARION and UNITED STATES PENITENTIARY.
