Case DescriptionAmerican Oversight submitted FOIA requests to the Department of Justice and the Department of Homeland Security for records concerning emails containing the term "American Academy of Pediatrics" or "AAP." American Oversight also submitted a FOIA request to U.S. Customs and Border Protection for records concerning guidance on former Attorney General Jeff Sessions' immigration enforcement memos issued in April 2017 and April 2018. The agencies acknowledged receipt of the requests. After hearing nothing further from either agency, American Oversight filed suit.

2019-08-20MINUTE ORDER: In light of the parties' 26 August 16, 2019 joint status report, the Court hereby ORDERS that by September 16, 2019, the parties meet and confer in a good faith effort to narrow plaintiff's various requests so as to reduce the volume of potentially responsive records that require processing and avoid overlap with plaintiff's pending requests in other cases. The parties shall report on their progress in a further joint status report to be filed on or before October 1, 2019. In that report, defendants shall update the Court on their search in response to the "Jeff Sessions FOIA," including a more detailed explanation of the "capacity issues with its system" that have prevented the search from being commenced to date. Meanwhile, ICE and USCIS shall continue processing the "DHS Keywords FOIA" at a rate of 500 pages per month, with rolling monthly productions, and DHS shall process the request at a rate of 250 pages per month. At the June 22, 2021 status conference, the Court expressed concerns about the large volume of potentially responsive documents that remain to be reviewed by CBP. In response to these concerns, the parties indicated that they would work together in an effort to narrow the CBP portion of the search. The latest report indicates that the time needed to complete CBP's first-level responsiveness review has been reduced from over 22 months to a still lengthy "6-12 months." But it does not indicate the results of the parties' discussions about narrowing the search. Nor does it address the fact that, at a rate of "at least 350 pages per month," it could take CPB as long as 29 years to complete its "final review before release" of the 121,258 pages of documents that presumably have been deemed responsive following the first-level review. 2021-10-22MINUTE ORDER: Having reviewed the parties' latest 48 Joint Status Report, the Court agrees with plaintiff's proposal that a review of a sample of the 54,576 pages of documents returned from the new search using plaintiff's revised search terms could help determine whether those responsive documents are over-inclusive and, if so, could guide plaintiff's efforts to further narrow its search terms. The Court therefore directs defendants to produce a random sample of 500 pages of records within 45 days of this Order. The Court also notes that while FOIA may not "require the agency to secure Plaintiff's consent to a particular search," JSR at 2, the statute does obligate agencies to conduct an adequate search. As this Court recently observed, doing so requires agencies to search "all files likely" to contain responsive records, not simply those that are "most likely" to have responsive records. Sarras v. Dept of Justice , No. 19-cv-861 (CRC), ECF No. 44, slip op. at 9 (D.D.C. Aug. 5, 2021); see also, e.g. , DiBacco v. U.S. Army , 795 F.3d 178, 190 (D.C. Cir. 2015) ("'[M]ost likely' is not the relevant metric."). Accordingly, waiting until summary judgment to litigate CBP's decision to limit its search to Director McAleenan's emails because he is the "most likely" custodian of relevant documents, as the government suggests (JSR at 2), could well lead to a finding that the agency clearly disregarded its obligation to conduct an adequate search.
