Case DescriptionJudge Amit Mehta has ruled that the Executive Office for U.S. Attorneys and the FBI have not shown that they properly responded to Arander Hughes' FOIA request for records about himself that were in the custody of the Western District of North Carolina. After Hughes filed suit, EOUSA searched for responsive records and provided Hughes with 220 pages, 67 of which had redactions. EOUSA withheld 77 pages in full. As part of its search, EOUSA referred 255 pages to the FBI. The FBI released 35 pages in full and 168 pages in part and withheld 52 pages in full. Mehta found the search was adequate, noting that Hughes had specifically asked for records from the Western District of North Carolina, that USAO-WDNC had thoroughly explained how it conducted the search and "plaintiff did not challenge any of the [agency's] representations or Defendants' arguments as to the adequacy of the search." EOUSA did not process records related to Hughes' two co-defendants, claiming Hughes only asked for records on himself. It also did not process court-filed public records, noting that its policy was to not process such records unless the requester specifically asked for them. Mehta disagreed with the agency as to whether Hughes had asked for records concerning his co-defendants. He noted that Hughes asked for records containing his name. He pointed out that "plaintiff's use of the word 'containing' implies a broader scope of records than only those 'regarding' him. A document that might reasonably be read to not 'regard' Plaintiff nevertheless still might 'contain' his name and therefore be responsive to the request. EOUSA, however, ignored the plain text of Plaintiff's request in favor of a hyper-technical reading of the caption of Plaintiff's letter." Mehta sided with EOUSA on whether it was required to search and disclose court-filed public records because Hughes' only challenge to the practice was whether those records were protected by the privacy exemptions. However, Mehta questioned the status of records because they had originally been filed with the court by Hughes himself. Mehta found EOUSA had properly withheld records under Exemption 5 (privileges), citing the attorney work product privilege. He also agreed with the agency that personally identifying information on government personnel and third parties were properly protected by Exemption 7(C) (invasion of privacy concerning law enforcement records). But he found that EOUSA had improperly redacted the names of Hughes' co-defendants and ordered them disclosed. Mehta found that Hughes had substantially prevailed and was entitled to recover his litigation fees of $350. He particularly faulted EOUSA for claiming that Hughes' request did not relate to his co-defendants and that their names were properly protected by Exemption 7(C).
