| 2013-11-18 | | MINUTE ORDER: This matters arises from a FOIA request that plaintiff Citizens for Responsibility and Ethics in Washington ("CREW") filed with defendant IRS in November 2012 seeking certain records related to the agency's regulation of tax-exempt organizations. After the agency received CREW's FOIA request, the Treasury Inspector General for Tax Administration commenced an investigation of the IRS's handling of tax-exempt organization applications. The agency has been required to respond to 73 formal Congressional requests and over 100 FOIA requests for the same information that CREW seeks, and as a result, has adopted a uniform procedure for retrieving and releasing records. Two productions of documents responsive to CREW's FOIA request have taken place thus far pursuant to that procedure: one on July 31, 2013, and one on November 15, 2013; the IRS anticipates that a final production will take place on January 15, 2014. In light of Defendant's representation that there is one additional set of responsive documents that can be compiled and produced by January 15, 2014, it is hereby ORDERED that Defendant shall produce any remaining non-exempt documents that are responsive to Plaintiff's FOIA request by January 15, 2014; and it is FURTHER ORDERED that, on or before February 5, 2014, the parties shall file a joint status report that includes a briefing schedule for the litigation of any outstanding issues.
