Case DescriptionRocky Creek Alliance submitted a FOIA request to U.S. Fish and Wildlife Service for records concerning the environmental impact of the Rock Creek and Montanore Mine projects on several species. The agency provided some records, but withheld 39 records under Exemption 5 (privileges). Rocky Creek Alliance filed an administrative appeal, but after hearing nothing further from the agency, Rocky Creek Alliance filed suit.
