FOIA Project Annotation: Judge Randolph Moss has ruled that that EOUSA has not shown that it conducted an adequate search for records in response to three FOIA requests from prisoner Richard King concerning his prosecution and conviction, which included proceedings in the Eastern District of New York and the District of Arizona. Moss had earlier found the agency's search was inadequate because it was based on the agency's assertion that the records were sealed. Finding this explanation insufficient, Moss ordered the agency to supplement its affidavits. This time, the agency told Moss that it could not confirm whether or not the records were sealed, but that it had conducted an adequate search and withheld records under Exemption 5 (privileges). Moss found the agency's revised position raised more questions than it answered. He pointed out that "the description offers little more than boilerplate that could be used in virtually any case in which a FOIA requester seeks records from one or more United States Attorneys' Offices. The reader is left to infer which office received the requests, and the declaration fails to identify who oversaw the search or what files, other than the LIONS system, were searched. Likewise, the declaration asserts that a 'systematic' search was conducted 'on each given subject,' but does not indicate what 'subjects' those charged with responding believed were implicated." Moss observed that although King had asked for all emails there were only a handful of emails produced. He indicated that "although it is possible that the only records that exist were sent to or received by the array of Assistant United States Attorneys, FBI Special Agents, and other lawyers identified in King's November 27, 2014 request are maintained in [the LIONS] system alone, just as it is possible that only 24 pages of records exist, the Department needs to do more to convince the Court that it has conducted a thorough search." Moss also noted that he was he was not convinced that many of the emails were privileged.

FOIA Project Annotation: Judge Randolph Moss has ruled that EOUSA has finally resolved a half-dozen year old FOIA lawsuit brought by prisoner Richard Alan King for records concerning the investigation and prosecution of charges against him in Arizona and New York. After Moss initially rejected the agency's claim that the disclosure of some records was prohibited by a court sealing order, the agency located 20,000 pages of potentially responsive records. The agency disclosed 8,818 pages in full and 77 pages in part, withholding 378 pages in full. Although King failed to respond to the agency's summary judgment motion, Moss pointed out that under Winston & Strawn v. McLean, 843 F.3d 503 (D.C. Cir. 2016), a non-FOIA case in which the D.C. Circuit held that district courts were required to rule on summary judgment motions even if unopposed by one party, he was required to assess the propriety of the agency's summary judgment motion. Doing so here, Moss noted that "where the FOIA requester does not take issue with the government's decision to withhold specific documents, the Court can reasonably infer that the FOIA requester does not seek those specific records and that there is no case or controversy with respect to those records sufficient to sustain the Court's jurisdiction." King continued to challenge the adequacy of the agency's search as well as whether he should have been charged costs. Moss agreed the agency had shown its search was adequate. He observed that "unlike in King I, the Department is no longer simply relying on the fact that certain records were filed seal in the underlying proceedings to justify withhold them in this case. To the contrary, AUSAs in Arizona sought leave to review those sealed materials and then released non-exempt records to King, with permission of the court that had entered the sealing order." Moss concluded that King did not deserve costs. He pointed out that "the record as it currently stands suggests that King sought records about his own criminal prosecution purely for his own benefit, and there is no indication that the public has any interest in learning additional details about King's court cases. Finally, although the litigation has 'dragged on for [more than] 5 years,' King is responsible for much of this delay, and, in any event, the delay has not increased his costs, which consist principally (if not entirely) of his initial filing fee."

Plaintiff has not presented any new evidence or other consideration that would justify vacating the Court's order denying him leave to file out of time. Instead, Plaintiff argues that he timely filed "part one" of his opposition under the prisoner mailbox rule because he delivered "part one" to prison authorities on March 23, 2017, five days before the Court granted Defendant's motion for summary judgment. Dkt. 63 at 4. The relevant deadline, however, was January 23, 2017--the date set by the Court when it granted Plaintiff's fourth motion for an extension. See Minute Order (Nov. 9, 2016). In that Minute Order, the Court also explained that "[n]o further extensions w[ould] be granted." Id. By Plaintiff's own account, he did not deliver "part one" of his opposition to prison authorities until two months after the firm deadline set by the Court after granting multiple extensions. The Court notes, however, that it has granted Plaintiff numerous, lengthy extensions of time over the course of this litigation and that Plaintiff's repeated extension requests (and failure to meet Court deadlines) have substantially delayed the resolution of this case. Defendant filed its pending motion for summary judgment, Dkt. 68, on February 5, 2018 over six months ago. At that time, the Court sua sponte granted Plaintiff until April 6, 2018 to file a response. See Feb. 6, 2018 Minute Order. The Court then granted Plaintiff a further extension until June 15, 2018. See Mar. 19, 2018 Minute Order. Defendant's pending motion for summary judgment, Dkt. 68, is now fully briefed. See Dkt. 74. To the extent that Plaintiff's reply in support of his own motion for summary judgment parallels arguments made in Defendant's motion for summary judgment, Plaintiff is advised that the Court intends promptly to resolve the Defendant's fully briefed and long-pending motion for summary judgment, Dkt. 68, and will do so on the basis of whatever papers are before the Court. If Plaintiff would like the Court to consider his cross-motion for summary judgment at the same time it considers Defendant's motion for summary judgment, he should file his reply brief on or before September 15, 2018. Otherwise, the Court will decide Defendant's motion for summary judgment before briefing is complete on Plaintiff's cross-motion. 2020-03-06MINUTE ORDER: On December 27, 2019, the Court directed Plaintiff to file a status report outlining in reasonable detail what issues, if any, remain for litigation in this case. (Minute Order Dec. 27, 2019). On February 25, 2020, Plaintiff filed a status report identifying three issues that purportedly remain to be litigated. Dkt. 94. First, Plaintiff asks that the Court require that the Department of Justice respond to a FOIA request he sent in 2019. Id. at 2. That request, however, is not part of this litigation. Second, Plaintiff contends that the Court should review documents pertaining to a 2012 FOIA request that, again, is not at issue in this case. Compare id. at 3-4 (discussing a 2012 FOIA request), with Dkt. 1 at 2 (Compl.) (alleging a claim arising from a 2014 FOIA request). Third, Plaintiff asks the Court to "order the DEA to disgorge any 'Johnny' reports in the DEA file." Id. at 5. But, as Defendants note, the Court has already held that DOJ properly withheld those documents pursuant to FOIA Exemption 7. Dkt. 47 at 6. In short, the issues identified by Plaintiff are either not part of this lawsuit or have already been resolved by the Court. 2020-07-10MINUTE ORDER: This case has been pending for five years and, as far as the Court can discern, nothing remains to be decided. On December 27, 2019, the Court directed Plaintiff to outline in reasonable detail what issues, if any, remain for litigation in this case. Minute Order (Dec. 27, 2019). In response, Plaintiff identified three issues that are either not part of this lawsuit or that have already been resolved by the Court. Minute Order (Mar. 6, 2020). In light of Plaintiff's pro se status, however, the Court allowed Plaintiff a second bite at the apple, again ordering him to show cause why the Court should not enter final judgment. Rather than respond, Plaintiff requested that the Court stay the proceeding because the facility he is detained at is on modified operations due to the pandemic. Dkt. 96. The Court then stayed the case through June 1, 2020. Minute Order (Apr. 1, 2020). The government has now filed a status report indicating that, although Plaintiff's facility remains on modified operations, he has "daily access to the Trust Fund Limited Inmate Computer System, the electronic law library, and the phone," and, in its view, "has the ability to respond" to the Court's show cause order. Dkt. 97 at 3. The Court agrees. Although the Court understands that Plaintiff may have limited access to research materials and a typewriter, see Dkt. 98, all that the Court is requiring is that Plaintiff identify any issue that still requires a decision. Plaintiff can easily provide the Court with any such information in a short, handwritten submission. Accordingly, Plaintiff is hereby ORDERED to show cause on or before August 12, 2020, why the Court should not enter final judgment in this matter. Plaintiff is cautioned that, absent extraordinary circumstances, this is the final opportunity for him to identify any remaining issue for decision. Signed by Judge Randolph D. Moss on 07/10/2020.
