Case DescriptionRaffi Khatchadorian, a staff writer for the New Yorker, submitted a FOIA request to the Defense Intelligence Agency for records concerning the Information Review Task Force, a multi-agency unit created within DIA to assess the impact on the United States of the documents disclosed on the Wikileaks website. DIA acknowledged receipt of the request and after a number of inquiries from Khatchadorian concerning the request, DIA informed him that it was far back in the queue for processing. DIA ultimately disclosed some records but withheld others under Exemption 1 (national security), Exemption 3 (other statutes), Exemption 5 (privileges), and Exemption 6 (invasion of privacy). Khatchadorian appealed the agency's denial. After hearing nothing further from the agency, he asked OGIS to help him get a response to his appeal. OGIS looked into the matter but had no success in getting DIA to respond to Khatchadorian's appeal. Khatchadorian then submitted a second FOIA request to DIA for information about the processing of his first request and subsequent appeal. After hearing nothing further from the agency concerning either request. Khatchardorian filed suit.

FOIA Project Annotation: Judge Royce Lamberth has ruled that the Defense Intelligence Agency properly responded to two FOIA requests filed by journalist Raffi Khatchadourian for records concerning the findings of the Information Review Task Force, convened by the Secretary of Defense to assess the damage to national security caused by the release of classified information to Wikileaks. Khatchadourian asked for a records from DIA's email system, which originally was estimated to encompass 1.8 million records, which was narrowed to 118,000, then to 18,000. DIA located 1,750 emails and 650 records from its database, concluding that only five emails and seven additional attachments were responsive. The agency identified 5,000 responsive pages, withholding records under Exemption 1 (national security), Exemption 3 (other statutes), Exemption 5 (privileges), Exemption 6 (invasion of privacy), and Exemption 7 (law enforcement records). Khatchadourian argued that the agency had failed to conduct an adequate search, in part because the agency had interpreted his request too narrowly by concluding that its first broader prong was modified by its second narrower prong. Lamberth disagreed, noting that "the difference in wording would lead a reasonable person to conclude that the scope of the first prong is broader than the scope of the second prong. It is true that agencies have a 'duty to construe a FOIA request liberally.' This does not, however, mean that agencies are prohibited from reasonably interpreting FOA requests." Lamberth also dismissed Khatchadourian's claims that DIA had failed to follow up on clear leads, finding that his allegations were merely speculative. Lamberth agreed that DIA had properly re-classified some records. He pointed out that "DIA was entitled to reprocess the records and change its mind about whether they were classified. Agencies frequently do this, and oftentimes they realize that they can release documents they previously thought should be exempt. If agencies can later release information they previously withheld, there is no reason why the reverse should be impermissible." Lamberth approved of the agency's Exemption 3 claims as well. But he found that the agency's segregability analysis for both Exemption 1 and Exemption 3 was conclusory and ordered the agency to provide further affidavits addressing that issue. Lamberth rejected the agency's deliberative process privilege claims, finding that the agency had not shown the records were predecisional or deliberative.

FOIA Project Annotation: Judge Royce Lamberth has resolved the remaining issues in FOIA litigation brought by journalist Raffi Khatchadourian against the Defense Intelligence Agency for records concerning the Information Review Task Force created by the agency to review the impact of the Wikileaks disclosures. In his first ruling. Lamberth found the agency's Exemption 1(national security) and Exemption 3 (other statutes) were appropriate, but it had not provided a sufficient segregability analysis. Since many essential staff at DIA had retired or moved to other positions, the agency put together a group of subject matter experts to re-review those records and conduct a new segregability analysis. When it completed its re-review and provided a new segregability analysis, DIA moved for summary judgment. Lamberth first dismissed Khatchadourian's argument that the agency had acted in bad faith by taking so long to process his request. He pointed out that "here, defendants engaged in an unprompted second-round of review and produced these documents on their own accord. Khatchadourian's argument is not just unsupported in this case. It would also create the perverse incentive against subsequent disclosure by agencies the D.C. Circuit has instructed this Court to avoid." Lamberth then noted that the agency had previously "submitted only a 'conclusory' segregability analysis that was insufficient to demonstrate adequate segregability. Now, defendants proffer a more detailed process for this Court's review. . .While Khatchadourian pays lip service to the segregability analysis, in reality he challenges defendants' withholdings â€" which this Court has already determined are proper. The Court finds the newly described segregability analysis demonstrates adequate segregability and rejects Khatchadourian's challenges." Lambeth indicated that "here, two members of DIA's staff have filed sworn affidavits including extensive explanations of the multiple level, line-by-line review of each document." DIA relied on § 3024(i)91) as the basis for withholding records under Exemption 3, which protects sources and methods. Khatchadourian challenged the withholding of information under the heading of "Expected Media Treatment." Accepting the agency's claims, Lamberth noted that "defendants argue that discussions of potential media treatment tend to reveal what news media the government tracks within a particular country and its individualized assessments of the motivations or trustworthiness of international news sources. This 'describes the justifications for withholding the information with specific detail [and] demonstrates that the information withheld [logically] falls within the claimed exemption.'" The agency withheld portions of records under the deliberative process privilege. Lamberth approved of those withholdings. Responding to Khatchadourian's challenge that talking points for internal discussions were final, Lamberth pointed out that "while Khatchadourian argues that these are not predecisional because they were used for internal meetings and thus adopted, he seems to misunderstand the nature of the relevant decision. Defendants do not argue that the relevant decision was what to say in the internal meeting. For example, the Vaughn Index for (one of the records in question) explains that the relevant decision was the 'impact assessment of the unauthorized disclosure of information resulting from leaked documents.'"
