2017-06-0530DECISION AND ENTRY OVERRULING PLAINTIFF STEPHEN PAYL JARRELL'S MOTION FOR JUDGMENT ON THE PLEADINGS (DOC. # 23 ); PLAINTIFF'S CLAIM ONE AGAINST THE SECRETARY SHALL PROCEED TO DISCOVERY. - On February 15, 2017, this Court adopted the Report and Recommendations of Magistrate Judge Sharon L. Ovington, Doc. # 18 , and dismissed with prejudice the following: (1) all twelve of Plaintiff Stephen Paul Jarrell's ("Plaintiff") Claims in his Amended Complaint, Doc. # 4 , against Benjamin Glassman, Acting United States Attorney for the Southern District of Ohio, and Jefferson Sessions, United States Attorney General; and (2) Claims Two through Twelve against David Shulkin, Secretary of the Department of Veterans Affairs ("Secretary"). Doc. # 20 , PAGEID #196. Subsequently, the Secretary answered Claim One of the Amended Complaint. Doc. # 22 , PAGEID #198. On March 7, 2017, Plaintiff filed a motion for judgment on the pleadings under Rule 12(c) ("Motion for Judgment"). Doc. # 23 , PAGEID #200. The Secretary filed motions for extension of time to respond to the Motion for Judgment on March 31, 2017, Doc. # 24 , and April 24, 2017, Doc. # 27 , and Magistrate Judge Sharon L. Ovington sustained both motions in notation orders on April 14, 2107 and April 25, 2017, respectively. On May 12, 2017, the Secretary filed his memorandum contra. Doc. # 29 . Plaintiff did not file a reply memorandum. The Motion for Judgment and its supporting memorandum do not address Claim One, which alleges that the Secretary, on or about February 9, 2015, "failed to respond to a request for a record of the summary of evidence used... in a [January] 14, 2015 Determination." Doc. # 4 , PAGEID #18. Rather, Plaintiff focuses on the subject matter of Claims Two through Twelve. As Plaintiff has set forth no reason why he is entitled to judgment as a matter of law on Claim One, the Motion for Judgment must be overruled. Even liberally construing Plaintiff's Motion for Judgment as one for reconsideration under Rule 59 of the Court's dismissal of Claims Two through Twelve, the Motion for Judgment is still not well-taken. Plaintiff does not discuss any "actual-that is, pecuniary or material-harm[,]" F.A.A. v. Cooper, 566 U.S. 284, 296, 132 S.Ct. 1441, 182 L.Ed.2d 497 (2012), that he allegedly suffered as a result of the Secretary's alleged violations of 5 U.S.C. § 552a(g)(1)(C-D), the statutory sections under which Claims Two through Twelve arise. Doc. # 12 , PAGEID #80. Absent any such harm, Plaintiff is barred from recovery. Cooper, 566 U.S. at 296. Thus, the Court's February 15, 2017 Entry dismissing with prejudice Claims Two through Twelve as against the Secretary was proper, and will not be altered.
