Case DescriptionThe Knight First Amendment Institute submitted FOIA requests to the Department of Homeland Security, the Department of State, and the Department of Justice for records concerning new vetting policies. The Knight First Amendment Institute also requested expedited processing and a fee waiver. The agencies acknowledged receipt of the request and several of them granted the Knight First Amendment Institute's request for expedited processing. U.S. Immigration and Customs Enforcement denied the Knight First Amendment Institute's request for expedited processing. The Knight First Amendment Institute filed an administrative appeal of that denial and as a result, the agency disclosed 1,666 pages, but redacted all but 13 pages in their entirety. After hearing nothing further from the agency, the Knight First Amendment Institute filed suit.

FOIA Project Annotation: A federal court in New York has ruled that U.S. Immigration and Customs Enforcement has not shown that it conducted an adequate search, but that the Office of Legal Counsel at the Justice Department did conduct an adequate search in response to a multi-agency request from the Knight First Amendment Institute concerning the government's authority to exclude or remove individuals from the United States based on their speech, beliefs, or associations. The court also found that the Department of State had properly invoked Exemption 5 (privileges) but has not yet supported its Exemption 7(E) (investigative methods or techniques) claims. ICE located 2,677 pages, withholding most those pages in full or in part. OLC located 128 pages, withholding them all under Exemption 5. State located 243 records, totaling 1,719 pages. It disclosed 90 records in full and 126 records in part and withheld 16 records in full. The court found ICE's search insufficient. The court pointed out that 'because the Office of the Director failed to search for additional terms the agency itself would have used in referring to the relevant statutory provisions �" and offers no reasonable justification to support its decision �" ICE has not established the adequacy of the Office of the Director searches." KFAI argued that OLC should have searched White House records. But the court observed that "as a practical matter, one agency does not have access to another agency's records systems. Therefore, as a matter of law, OLC was not obliged to search White House records." The court found that the State Department's deliberative process privilege claims were justified since the records were both pre-decisional and deliberative. KFAI argued the records constituted working law as an expression of the Trump administration's immigration policy. However, the court pointed out that "reflection is not adoption. Reports or recommendations that have 'no operative effect' do not need to be disclosed even where the agency action agrees with the conclusion of the report or recommendation." The court rejected State's claim that portion of the Foreign Affairs Manual could be withheld under Exemption 7(E). The court observed that 'the mere descriptions of codified law and policy, even those including 'interpretation and application of immigration laws and regulations' are not protected under Exemption 7(E). To be 'compiled for law enforcement purposes,' the information must go a step further and describe the 'proactive steps' for preventing criminal activity and maintaining security."

FOIA Project Annotation: A federal court in New York has declined to reconsider its earlier opinion finding that U.S. Immigration and Customs Enforcement failed to conduct an adequate search and that both U.S. Citizenship and Immigration Services and the Department of State had failed to show that Exemption 7(E) (investigative methods and techniques) applied to some of the records the agencies withheld. The Knight First Amendment Institute submitted a FOIA request to multiple agencies for records concerning communications sent from the White House to agencies regarding the consideration of individuals' speech, beliefs, or associations in connection with immigration determinations. ICE located 14,000 pages of potentially responsive records, disclosing 463 pages in one response and 395 pages in a second response. After the Knight First Amendment Institute narrowed its request to expedite processing, ICE located an additional 99 pages, releasing 50 of them. The agencies asked District Court Judge Andrew Carter to reconsider his ruling that ICE's search was inadequate and that USCIS and State's Exemption 7(E) claims were inappropriate. ICE argued that Carter had overlooked supplemental affidavits from the agency that further explained its search, including the search terms it used. Carter indicated that he considered all of ICE's affidavits but still found the wanting. He noted that "although these search terms are better than none, they do not, as Defendants erroneously argue, mirror the terms used by [the Office of Legal Counsel at the Department of Justice] and [the Department of State], which I cited with approval." Carter also faulted the agency's search for the date restrictions used, noting that "ICE conducted all searches by January 2018, before the administrative remand was requested let alone granted." In his first opinion, Carter found that Terrorism-Related Inadmissibility Grounds (TRIG) questions could not be withheld under Exemption 7(E), but that TRIG exemption could be withheld. Both State and USCIS indicated that they had difficulty distinguishing between the two. Carter explained that "I understand TRIG Questions to be 'the questions and follow-ups' 'designed to elicit' information from applicants 'that would shed light on whether the applicants have any ties to terrorist organizations and activities.' TRIG Exemptions, by contrast, are the criteria USCIS uses to evaluate applicants' answers. The latter material is internal to the agency and protectable, whereas the former material is, by definition shared, specially with applicants." He also indicated that in rejecting the agencies' Exemption 7(E) claims he had meant to order disclosure, not clarification.

Defendants-Appellants United States Citizenship and Immigration Services, United States Department of State, and United States Immigration and Customs Enforcement appeal from three orders of the district court requiring them to produce documents in response to requests from Plaintiff-Appellee the Knight First Amendment Institute at Columbia University under the Freedom of Information Act. The district court (Andrew Carter, J.) ordered disclosure of three sets of documents: (1) portions of Volume 9 of the Foreign Affairs Manual; (2) the questions that are used to determine whether to apply the "Terrorism Related Inadmissibility Ground" to applicants for immigration benefits; and (3) a memo titled "ICE Ability to Use 212(a)(3)(C) Foreign Policy Charge." We hold that the Department of State and United States Citizenship and Immigration Services properly withheld the first two sets of documents under FOIA Exemption 7(E). We therefore REVERSE the orders of the district court requiring disclosure of those materials.
