Case DescriptionMuslim Advocates and the Center for Constitutional Rights submitted FOIA requests to the Department of State and the Department of Homeland Security for records concerning the waiver provisions of the Trump administration's enhanced vetting policies. Muslim Advocates and CCR also requested a fee waiver and expedited processing. DHS granted the organizations' expedited processing and fee waiver requests. U.S. Citizenship and Immigration Services denied the organizations' request for expedited processing, but granted their request for a fee waiver. U.S. Customs and Border Protection denied the organizations' requests for expedited processing and a fee waiver. The Department of State did not acknowledge the organizations' request. After hearing nothing further from either agency, Muslim Advocates and CCR filed suit.

2021-12-28MINUTE ORDER: On 1/29/2021, the court ordered the parties to "meet, confer, and file a Joint Status Report by 3/29/2021 and every 60 days thereafter. " However, it appears from the 11/24/2021 report that the parties are not meeting and conferring before filing their joint reports. Moreover, in that report the Plaintiffs state that they sent a settlement proposal to the Defendants that would considerably narrow the universe of document at issue and possibly lead to dismissal of this action, but the Defendants did not respond. Plaintiffs further state that they have contacted the Defendant repeatedly about the proposal, but have yet to receive a response. Accordingly, by 1/31/2022 the Defendants shall send the Plaintiffs a written response to their proposal. By 2/7/2022 the parties shall meet and confer either in person or electronically and discuss the current search as well as Plaintiffs' proposal and the Defendants' response. The goal of this meeting shall be to determine where there are areas of agreement that might lead to settlement of this action. By 2/10/2022 the parties shall file a joint status report and proposed order. The court will view with disfavor a parties' failure to respond to a settlement offer by opposing counsel. Signed by Judge Tanya S. Chutkan on 12/28/21. (DJS) Modified on 12/29/2021 to reflect the correct year of "2022" for the January and February filing schedule dates (jth). (Entered: 12/28/2021)
