Case Number1:2018cv02791

Date ClosedOpen
JudgeJudge Christopher R. Cooper
PlaintiffJOSEPH MICHAEL GUARASCIO
Case DescriptionJoseph Guarascio, a federal prisoner, submitted FOIA requests to the Department of Justice and the FBI for records concerning evidence used in his case. The agencies acknowledged Guarascio's requests, but denied them on the basis that his plea agreement prohibited him from making FOIA requests about his conviction. Guarascio filed administrative appeals of denials by the FBI and the Bureau of Prisons. His appeals were consolidated by the Office of Information Policy, which upheld the agencies' original decision. Guarascio then filed suit.

Defendants shall complete their coded releases to Plaintiff by July 17, 2020. After reviewing Defendants' coded releases, Plaintiff shall file a status report indicating what issues, if any, remain by August 17, 2020. If any issues remain to be addressed, summary judgment briefing shall proceed according to the following schedule: Defendants shall file their Motion for Summary Judgment by September 18, 2020; Plaintiff shall file his opposition by October 16, 2020; and Defendants shall file their reply by November 6, 2020. In addition, the Court encourages the Government to consider Plaintiff's request for a fee waiver for the production of digital media (or production by alternative means), see ECF 16 , as well as his contention that recently released records suggest the existence of other responsive records in the agency's possession, see ECF 19 . The Court takes no position on either issue. It simply notes that resolving them voluntarily could reduce the number of disputed issues at the summary judgment stage. Signed by Judge Christopher R. 2024-02-29MINUTE ORDER: In its January 12, 2024 Minute Order, the Court directed Defendants to file their supplemental declaration relating to the issues on which the Court reserved judgment in its 55 Memorandum Opinion and Order and directed Plaintiff to file any response by February 19, 2024. From the record, though, Plaintiff did not respond to the Defendants' 58 Supplemental Response and their corresponding request that the Court enter judgment in their favor. Plaintiff is therefore ordered to file any response by March 14, 2024. Failure to do so may result in the Court treating the remaining issues as conceded under the Court's Local Civil Rule 7(b) and granting summary judgment in favor of Defendants.
