Case DescriptionJoseph Mermelstein submitted a FOIA request to the FBI for records concerning himself. The agency told Mermelstein that it had located 2,156 responsive pages which could be released on CDs for a cost of $70. The agency told Mermelstein's attorney that it would take five years to disclose all the records, but the agency could disclose 720 pages within two years. Mermelstein rejected that offer. He then filed suit.

2021-08-19ORDER ADOPTING REPORT AND RECOMMENDATIONS for 30 Report and Recommendations, 31 1 - Exparte Docket Entry AND Document CV, Motion for Extension of Time to File Document filed by Joeseph Mermelstein, 33 Motion for Extension of Time to File Document filed by Joeseph Mermelstein, 34 Motion for Extension of Time to File Document filed by United States Department of Justice, Federal Bureau of Investigation Plaintiff Joseph Mermelstein commenced this action against defendant United States Department of Justice, Bureau of Investigation, alleging defendants were wrongfully withholding documents that plaintiff properly requested pursuant to the Freedom of Information Act. Defendants filed a motion for summary judgment, DE 19, and plaintiff filed a cross-motion for an in camera review of every document withheld by defendants, DE 23. In a Report and Recommendation dated August 4, 2021, the Honorable James M. Wicks recommended that defendants' motion be granted in part, plaintiff's cross-motion for in camera review be denied, and that defendants be given fourteen (14) days to file additional documents pertaining to a court sealing order to support its motion. On August 16, 2021, counsel for plaintiff filed two applications for an extension of time to file objections to the Report and Recommendation, DE 31, 32, which the undersigned granted in part. On August 17, 2021, counsel for plaintiff filed an additional application for an extension of time based on personal and medical reasons, DE 33. On August 18, 2021, Defendants filed an application requesting an extension of time to provide the additional information regarding documents withheld pursuant to a Court sealing order due to the fact that the court proceeding at issue was conducted in 2004 and relevant records are not electronically available. DE 34. Defendants explained that in order to properly comply with the Report and Recommendation, the FBI must physically search and locate relevant 17-year old records stored in paper archives. Id. All parties to this action consent to the respective requests for additional time. Id. The Court has conducted a careful review of the Report and Recommendation, DE 30. In light of the (1) parties' submissions, to wit, plaintiff's multiple applications for an extension of time to file objections and defendants' need for additional time to provide additional information and documents pursuant to a Court sealing Order; and (2) Judge Wicks' exceedingly thorough and well reasoned Report and Recommendation, the Report and Recommendation is hereby AFFIRMED in its entirety. All objections thereto may be renewed after the supplemental documents have been provided and Judge Wicks has had the additional time to review said documents. 2022-03-31ORDER ADOPTING REPORT AND RECOMMENDATIONS for 47 Report and Recommendations, 19 Motion for Summary Judgment filed by United States Department of Justice, Federal Bureau of Investigation ; adopting Report and Recommendations as to 47 Report and Recommendations and granting Defendant's motion for summary judgment 19 ; denying Plaintiff's cross-motion 23 . Presently before the Court is the Report and Recommendation dated March 4, 2022, DE 47, of United States Magistrate Judge James M. Wicks recommending that Defendant's summary judgment motion, DE 19, be granted, and Plaintiff's cross-motion for <in camera review, DE 23, be denied in its entirety. In reviewing a Report and Recommendation, the district court "may accept, reject, or modify, in whole or in part, the findings or recommendations made by the magistrate judge." 28 U.S.C. § 636(b)(1). Where a party makes specific and timely objections to a Magistrate Judge's findings or recommendations as to dispositive motions, the district court must apply a de novo standard of review to the portions of the Report and Recommendation to which the objection is made. Fed. R. Civ. P. 72(b); see LLC v. Doe 3 , 604 F.3d 110, 116 (2d Cir. 2010); see also 28 U.S.C. § 636(b)(1). However, "general or conclusory objections, or objections which merely recite the same arguments presented to the magistrate judge, are reviewed for clear error." Caldarola v. Town of Smithtown , No. 09-cv-272, 2011 U.S. Dist. LEXIS 37280, at *1 (E.D.N.Y. Apr. 4, 2011). The Court has carefully reviewed and considered Plaintiff's objections and finds that they fail to raise any colorable objection to the Report and Recommendation and principally restate the conclusory allegations set forth in Plaintiff's motion papers. Because Plaintiff's objections largely consist of general conclusory arguments as well as facts and issues that were presented to Judge Wicks, the undersigned may review the Report and Recommendation for clear error. Nevertheless, although de novo review is not required, the Court has conducted a de novo review of the Report and Recommendation in an abundance of caution. Having carefully reviewed Plaintiff's objections, the motion papers, the applicable law, and having conducted a careful review of the Report and Recommendation de novo , the Court adopts the findings and recommendations contained in the well-reasoned and exceedingly thorough Report and Recommendation dated March 4, 2022, DE 47, of Magistrate Judge Wicks in their entirety. 28 U.S.C. § 636(b)(1)(B); Fed. R. Civ. P. 72(b); see Caldarola , 2011 U.S. Dist. LEXIS 37280, at *1; see also Thomas v. Arn , 474 U.S. 140, 150 (1985); Mario v. P & C Food Mkts., Inc. , 313 F.3d 758, 766 (2d Cir. 2002); Piroleau v. Caserta , No. 10-CV-5670 (SJF), 2012 WL 5389931, at *1 (E.D.N.Y. Oct. 29, 2012). Accordingly, IT IS HEREBY ORDERED that Defendant's summary judgment motion, DE 19, be granted in its entirety, and Plaintiff's cross-motion for <in camera review, DE 23, be denied in its entirety.
