FOIA Project Annotation: Judge James Boasberg has ruled that the FBI did not receive prisoner William Ball's FOIA request and has dismissed Ball's suit. Ball filed suit against the U.S. Marshals Service, the Department of Homeland Security, the U.S. Secret Service, and the FBI after the agencies failed to respond to his request for records about his conviction. Boasberg initially dismissed Ball's claim under the Administrative Procedure Act, noting that "his only articulated cause of action relies on FOIA and the Privacy Act." Ball had conceded his claim against the Secret Service. Since the FBI was the only other agency that had filed a summary judgment motion, Boasberg indicated he would only rule as to the FBI and leave the other agencies to another time. The FBI argued that it could find no records of Ball's alleged request. Boasberg noted that "the Court will dismiss the Privacy Act claim because Plaintiff 'does not offer proof via, e.g., a certified-mail receipt of any other form of mailing that his missive reached [its] intended target.'" He found Ball had done no better under FOIA in proving that the agency had received his request. He observed that "again, as Plaintiff's offers no evidence beyond is own say-so, the Court concludes on summary judgement that his claim to have mailed the request to the FBI is defeated by the Bureau's sworn declaration that it was not received." He added that "Plaintiff is, of course, free to file the identical request and resubmit it to the FBI, which will then trigger a Bureau response."

FOIA Project Annotation: Judge James Boasberg has ruled that the three agencies remaining in William Ball's FOIA litigation �" the Department of Homeland Security, U.S. Marshals Service, and the Department of the Treasury �" have now shown that they conducted an adequate search and properly withheld records under Exemption 3 (other statutes), Exemption 7(C) (invasion of privacy concerning law enforcement records), and Exemption 7(E) (investigative methods or techniques). Ball, who is serving a federal sentence in Florida, requested records related to his conviction. The three agencies were the only ones remaining in Ball's suit. Boasberg noted that Ball had failed to file an opposition but indicated that under Winston & Strawn v. McLean, 843 F.3d 503 (D.C. Cir. 2016), he was required to assess independently the government's case even without the plaintiff's participation. Here, he found that agencies had shown that their searches were adequate and that their exemption claims were appropriate. Boasberg noted that the Federal Victim and Witness Protection Act qualified as an Exemption 3 statute. He explained that "the statute prohibits the Government from disclosing documents in connection with a criminal proceeding that reveal 'the name or any other information concerning a child,' as well as information in those documents, 'that concerns a child.' Here DHS 'withheld names and other information about child victims and witnesses.' Its explanation of why this was appropriate in regard to child-pornography materials strikes the Court as appropriate and is not challenged."

FOIA Project Annotation: Judge James Boasberg has ruled that the Department of Homeland Security, the U.S. Marshals Service, and the Department of Treasury have now shown that they conducted adequate searches and otherwise properly responded to prisoner William Ball's FOIA request to multiple agencies for records concerning his conviction on child pornography charges. U.S. Immigration and Customs Enforcement located 47 pages, which it provided with redactions. The Marshals Service released 21 pages with redactions, while Treasury told Ball it found no responsive records. Ball argued that USMS's search was inadequate because it failed to search two databases he believed were relevant to the request. However, Boasberg indicated that "USMS maintains that there was no reason to search the [Prisoner Operations Division] database because Ball's request did not cover medical records, and he did not receive medical care in USMS custody. Even if USMS had those records, moreover, the agency notes that they would have turned up in [the Justice Detainee Information System, the database USMS did search]; in fact, the released documents indicate no medical treatment besides a recurring prescription. The court agrees and thus upholds USMS's search." ICE had claimed the Federal Victim and Witness Protection Act, which prohibits the disclosure of information concerning the identity of a child, to withhold records under Exemption 3 (other statutes). Boasberg approved the withholding, noting that "ICE thus has complied with its statutory obligation to withhold names and identifying information about child victims." Turning to whether ICE had met the foreseeable harm standard, Boasberg observed that "given the foreseeable-harm requirement's recent vintage, precedents applying the required analysis to the exemptions at issue are relatively sparse." However, approving the foreseeable harm claims here, Boasberg indicated that "here, the agencies' statements in their declarations and the Vaughn Indexes have established foreseeable harm by 'connecting the harms in a meaningful way to the information withheld.' The agencies explain that releasing the personal identifying information of Government employees might subject them to harassment or public hostility."
