FOIA Project Annotation: Judge Colleen Kollar-Kotelly has ruled that records concerning the FAA's review of design changes to the Boeing Company's 737 MAX in the wake of two fatal crashes are protected by Exemption 4 (commercial and confidential). The Flyers Rights Education Fund submitted a request to the FAA for the agency's review of the design changes required by the agency to allow the 737 MAX to begin flying again. The agency located 49,000 pages of responsive records but narrowed the request to 9,443 pages. The agency provided documents to Boeing for confidentiality claims. The parties narrowed the request to 108 documents. The agency disclosed five documents in full and 22 documents with redaction of names of low-level Boeing employees under Exemption 6 (invasion of privacy), released 38 documents with redactions pursuant to Exemption 4 and Exemption 4, and withheld 37 documents entirely under Exemptions 4 and 6. Flyers Rights argued that the records were generated by the agency and had not been obtained from a person. Kollar-Kotelly disagreed, noting that "the FAA's description in its Vaughn Index establishes that this information was generated by Boeing, not the government and therefore satisfies the 'obtained from a person' requirement of Exemption 4." She then found the records withheld under Exemption 4 were provided to the agency in confidence by Boeing. She pointed out that "based upon its review of Boeing's and the FAA's supporting affidavits, the Court is satisfied that Boeing 'customarily and actually' treats these categories of disputed information as 'private.'" She also found that Boeing had received an assurance by the government that it would keep its information confidential. Here, she concluded that "the FAA has carried its burden to demonstrate that the disputed documents were provided to the agency under express and implied assurances of privacy. . . Accordingly, the FAA has demonstrated that the material withheld from production satisfies Exemption 4's definition of 'confidential' information."

2020-01-21MINUTE ORDER. The Court is in receipt of the parties' 9 Joint Status Report. Defendant indicates that, based on the narrowing of Plaintiff's FOIA request, Defendant has identified 86 responsive records, totaling 9,443 pages. The parties have not agreed on a production schedule. As an initial note, Defendant indicates that it currently has many pending FOIA requests concerning the Boeing 737 MAX, none of which have been granted expedited processing. As such, work done on Plaintiff's FOIA request will likely be responsive to other FOIA requests concerning the Boeing 737 MAX. In order to set a processing and production schedule, the Court ORDERS that by JANUARY 28, 2020, Defendant notify Plaintiff whether or not the document described as the "Complete System Description/Final Software Load" is included in Defendant's list of 86 documents. The Court further ORDERS that by FEBRUARY 4, 2020, Defendant provide Plaintiff with a list of the 86 documents. The list should set out the title, author, recipient, date, and number of pages for each document. Finally, the Court ORDERS that by FEBRUARY 10, 2020, Plaintiff submit a Status Report informing Defendant and the Court of Plaintiff's prioritization of the documents. The parties report that Boeing has identified 76 documents for which it objects to the release of information falling under FOIA Exemption 4. Boeing has also identified 19 documents for which it did not assert a FOIA Exemption 4 objection, and one additional document that was purely an FAA document. FAA has reviewed the documents for which Boeing does not object and expects to release four documents in full and expects to assert FOIA Exemption 6 with respect to portions of the other documents. The parties do not anticipate any material disputes. The FAA plans to release the documents, with the redactions, within the week. As to the documents over which Boeing objects, Boeing will review the documents to identify any segregable material at a rate of 1,000 pages of documents per month. As such, FAA will proceed with the processing of the remaining records and will use best efforts to process approximately 1,000 pages per month and produce any non-exempt responsive material on a rolling, monthly basis. The parties agree with the above approach, except that Plaintiffs request that the FAA obtain from Boeing, and provide to Plaintiffs on or before April 20, 2020, a statement of the grounds on which Exemption 4 has been invoked. The FAA intends to confer with Boeing regarding the statement and will respond to Plaintiffs within the week.
