2016-12-07MINUTE ORDER: The Court is in receipt of Plaintiff's 10 Motion for Enlargement of Time to Serve Summons and Complaint, in which Plaintiff appears to indicate that the Government does not oppose this Motion. The Court seeks clarification from the Government as to whether it is the Government's position that it has not been properly served in this matter and is therefore consenting to an extension of the period for Plaintiff to effect proper service. As an initial matter, the Court corrects an erroneous interpretation of its prior 163 Order on Defendants' 161 Motion to Decertify Plaintiffs' Uniform Maintenance Class. That Order, inter alia, decertified Plaintiffs' DCMWA uniform maintenance claim, and accordingly dismissed without prejudice the DCMWA uniform maintenance claims belonging to all 89 opt-in Plaintiffs. Contrary to Defendants' interpretation of that Order as relayed in the Status Report, that Order did not dismiss the individual uniform maintenance claims of the three Named Plaintiffs. Turning to the course of future proceedings in this action, the Court ORDERS that the parties shall appear for a status conference on MARCH 21, 2017 at 10:30 A.M. The parties shall be prepared to discuss whether further dispositive motions will be necessary in this action, and to schedule pretrial proceedings. 2017-03-21MINUTE ORDER: The Court is in receipt of Plaintiff's 20 Motion for Leave to File First Supplemental Complaint. As an initial matter, the Court clarifies an apparent misapprehension by Plaintiff regarding the import of the Court's prior Minute Order, dated February 23, 2017, permitting him to file an Amended Complaint. Following entry of that Order, the operative complaint in this action became the original Complaint, ECF No. 1, as supplemented by the First Supplemental Complaint, ECF No. 15. Consequently, despite Plaintiff's concerns, the Courts Minute Order did not act as a "voluntary dismissal of the claims and defendants not named in the First Supplemental Complaint." ECF No. 20, at 9. The Court notes that Defendant Department of State shares in this misapprehension, as its Answer purports that "this Court ruled that a response to the original complaint is no longer required...." ECF No. 18, at 2. Beyond relaying his concern that the operative Complaint include the allegations in the original Complaint, Plaintiff's Motion also seeks to further supplement the operative Complaint in this action, ECF No. 20 at 5, and to make the "Amended and Supplemental Complaint" attached to the Motion the operative Complaint in this action, ECF No. 20, Attach. 2. Plaintiff's Motion does not indicate whether Defendants consent to this amendment. Accordingly, by no later than MARCH 27, 2017, Defendants shall notify the Court whether they consent to or oppose Plaintiff's Motion to further amend the operative Complaint in this action, and if they oppose, on what basis. 2017-07-17MINUTE ORDER: The Court has received Defendants' 37 Motion for Enlargement of Time and Modification of Existing Briefing Schedule, and Plaintiff's 38 Opposition thereto. Defendants seeks an extension to file its motion for summary judgment, up to and including August 24, 2017, principally because additional time is necessary for consultation with the agencies from which materials are sought by Plaintiff. Plaintiff opposes because Defendants allegedly failed to confer regarding the motion pursuant to Local Civil Rule 7(m), and because Defendants' reasons for seeking an extension are allegedly insufficient. With respect to the former issue, Defendants are instructed to endeavor, to the extent feasible, to contact Plaintiff in manner that makes it likely that he will be able to provide input regarding a planned motion before the motion is filed. Nonetheless, for good cause shown, the Court GRANTS Defendants' 37 Motion for Enlargement of Time, except that it shall provide Plaintiff with the same time to respond (32 days) as he had under the previous schedule. Accordingly, Defendants' motion for summary judgment is due by AUGUST 24, 2017. Plaintiff's response is due by SEPTEMBER 25, 2017. Defendants' reply is due by OCTOBER 16, 2017. The record reflects that the defendants in this seven-year long matter have been granted numerous extensions. Most recently, on December 12, 2018, the Court made clear that it was not inclined to grant future requests for extensions of this briefing schedule. Yet, on February 26, 2019, five days after the defendant's reply was due, the defendant filed another motion for an extension seeking more than four additional weeks to file its reply brief. The plaintiff has advised the Court that he opposes the motion and intends to file an opposition today, but it is unlikely that the Court will receive the opposition for several days because the plaintiff is filing his opposition by mail. To avoid further delay, and in light of the plaintiff's anticipated opposition, the defendant's request for an extension to March 29, 2019 is DENIED. The defendant's reply brief shall be filed on or before March 12, 2019 and shall not exceed seven pages. The Court will grant no further extensions of the briefing schedule. The plaintiff's 78 Motion for Substitution of Exhibit #12, which remains unopposed, is granted and exhibits 12 through 35 that were attached to the motion shall replace exhibits 12 through 35 that were attached to the plaintiff's Opposition to Renewed Motion for Summary Judgment.
