2023-04-05MINUTE ORDER. The Court is in receipt of the 21 Notice providing additional information regarding Plaintiff's counsel's 20 Motion to Withdraw as Attorney. In the 20 Motion, Plaintiff's attorney Marwa Elbially attached a letter from Plaintiff Aafia Siddiqui asking to "transfer my case to Mr. Stafford Smith and please stop representing me." The 21 Notice now indicates that Clive Stafford Smith is a licensed attorney in Louisiana. He first visited Plaintiff Aafia Siddiqui in January 19, 2023 and has since published articles identifying himself as Plaintiff's attorney. Attorney Smith requested information about the present litigation from Plantiff's attorney, Marwa Elbially, via email on March 8, 2023. On March 24, 2023, after receiving written permission from Plaintiff and before filing the 20 Motion to Withdraw, Plaintiff's counsel emailed Attorney Smith the case file and related information; Plaintiff's attorney indicates that Attorney Smith did not respond to that email, nor a follow-up email, as of April 5, 2023. Attorney Smith is not a member of the bar of this Court. Accordingly, he cannot represent Plaintiff until he either files a motion to appear pro hac vice , which requires an attorney who is a member of this Court vouching for him, or becomes a member of the bar of this Court. At this time, Attorney Smith cannot file anything on the docket, appear in this Court on Plaintiff's behalf, make representations to this Court on Plaintiff's behalf, receive filings in this litigation, etc. Therefore, if the Court were to grant the 20 Motion to Withdraw as Attorney, Plaintiff would be proceeding pro se (representing herself without counsel). Plaintiff Siddiqui should discuss with Mr. Smith whether he will be taking steps to represent her in this Court. The Court ORDERS Plaintiff Siddiqui to file a notice by no later than APRIL 26, 2023 regarding her plans for representation. Until the Court rules on the 20 Motion, Attorney Elbially remains counsel for Plaintiff. The Court shall email a copy of this Order to Attorney Smith at the email address included in the 21 Notice, which is consistent with his email address available online. 2023-08-02MINUTE ORDER. The Court is in receipt of the 30 Consent Motion for Extension of Time to Modify Briefing Schedule. Defendant moves for an enlargement of time of thirty days to file their motion for summary judgment. They explain that they have "determined that it will issue a supplemental production in response to Plaintiff's third FOIA request, which is at issue in this litigation," and given that production, "the withholdings Defendant had relied upon will no longer be applicable and Defendant will produce much of the information that was previously withheld." Accordingly, they continue, they will need to prepare a new supporting Vaughn index and declaration. This is their second request for an extension, and Plaintiff consents to the relief. The Court notes that the 30 Motion is in violation of the Court's 4 Standing Order requiring that motions for extension be filed at least four business days prior to the affected deadline. The Court is in receipt of Defendant's 31 Joint Motion to Stay, in which the parties ask the Court to stay proceedings for ninety days and vacate the current briefing schedule. Per the Court's August 2, 2023 Minute Order, Defendants' Motion for Summary Judgment is currently due September 5, 2023. Defendant explains that the parties recently met and "Plaintiff's counsel has shared a much broader FOIA request that will be formally served on the relevant government officials this week" and that "Defendant has recently turned over additional material in compliance with the original request and will attempt to respond to the broader requests as soon as possible." They continue that "[i]f Plaintiff is dissatisfied with the response to her broader requests, she will seek to amend her complaint in this case or will file a separate complaint and seek to have it joined." The parties have previously sought modifications to the briefing schedule, but this is the first request for a stay. The Court GRANTS the 31 Motion and ORDERS that this case be stayed until NOVEMBER 24, 2023, on which date the parties shall file a Joint Status Report providing an update. They explain that they "have continued to work together to achieve a mutually agreeable solution to resolve the outstanding issues in this litigation," and that since the parties' last 31 Joint Motion, Plaintiff's counsel has "made the FOIA applications to broaden the issues before the Court (and hence potentially significantly vary the Defendant's briefing to this Court)." Plaintiff anticipates "filing with the Defendant a broad-based report on her allegations of sexual abuse in the custody of the Bureau of Prisons," which, "[a]ccording to Plaintiff's counsel has been held on the part of the Government of Pakistan, who finally noticed Plaintiff's counsel last week that they had made their promised representations to the U.S. Government." The Court GRANTS the 33 Joint Motion for Stay and ORDERS that this case remain stayed until FEBRUARY 22, 2024, on which date the parties shall file a Joint Status Report providing an update.
