Case DescriptionThe ACLU submitted a FOIA request to the FBI for records concerning whether the agency is still placing requirements on state and local law enforcement agencies that purchase or use cell site simulators. The ACLU also requested a fee waiver. The agency acknowledged receipt of the request. The agency issued a Glomar response neither confirming nor denying the existence of records under Exemption 7 (law enforcement records). The ACLU filed an administrative appeal the receipt of which was acknowledged by the agency. However, after hearing nothing further from the agency, the ACLU filed suit.

2023-05-3133STIPULATION AND ORDER OF SETTLEMENT AND DISMISSAL IT IS HEREBY STIPULATED AND AGREED, by and between the parties as follows: 1.The documents produced by FBI fully resolve all claims ACLU now has or may hereafter acquire against the FBI or the United States of America ("United States"), or any department, agency, officer, or employee of the FBI and/or the United States, for the release of records arising from ACLU's FOIA Request at issue in this action. 2. As soon as reasonably practicable after the Court has endorsed and docketed this Stipulation and Order, FBI shall pay to ACLU the sum of seven thousand nine hundred twenty-five dollars ($7,925) for attorneys' fees and litigation costs. This payment shall constitute full and final satisfaction of any claims by ACLU for attorneys' fees and litigation costs in this matter and is inclusive of any interest. Payment shall be made by electronic funds transfer, and counsel for ACLU will provide the necessary information to counsel for the FBI to effectuate the transfer.
