The Court is in receipt of Defendant's 11 Consent Motion, in which Defendants ask for an extension of time to file their Motion for Summary Judgment or to vacate the 9 Scheduling and Procedures Order that set a briefing schedule. Defendants have already asked for, and the Court has granted, one extension for their deadline to file a Motion for Summary Judgment. Defendants indicate in their 11 Motion that "[i]n conferring further about this matter with the agency following the last extension request, the agency has determined that there has been an oversight in terms of the search that was conducted as to both parts of the request" and accordingly, they will need to conduct the search to identify any potentially responsive records, which they anticipate taking as long as March 2023. In light of this information, the Court GRANTS the 11 Motion and VACATES the 9 Order; the Court ORDERS the parties to file a Joint Status Report by no later than March 31, 2023 with a proposed updated briefing schedule. 2023-03-31MINUTE ORDER. The Court is in receipt of the 12 Joint Status Report, in which the parties suggest they provide the Court with a status update on June 6, 2023. Defendant indicates they have completed their search for potentially responsive records and are reviewing said records for responsiveness and the applicability of FOIA exemptions, which they anticipate to be finished by June 6, 2023. Plaintiffs believe this to be "vague and minimal information" and therefore request that the Court seek greater detail and explanations from Defendant if it is unable to finish its review by June 6, 2023. Accordingly, the Court ORDERS the parties to file a Joint Status Report by no later than JUNE 6, 2023; if Defendant has not finished processing the records and provided a response to Plaintiffs regarding their FOIA request, Defendant shall include in that Joint Status Report additional details about the status of their processing.
