Case DescriptionThe Erickson Immigration Group submitted a FOIA request to the Department of Labor for records concerning implementation of the permanent labor certification program. The agency acknowledged receipt of the request. The agency told Erickson that most of the records were protected by Exemption 5 (privileges). Erickson filed an administrative appeal. After hearing nothing from the agency, Erickson filed suit.
