2023-02-16MINUTE ORDER re 14 Joint Status Report: The Court has reviewed the report and recognizes that the Parties disagree as to the date of Defendant's first disclosure. In addition, the Court notes that Defendant does not take a position on Plaintiff's request for a processing rate of 500 pages per month. Because Defendant provides no specific reasons why Plaintiff's proposals are unreasonable, the Court ORDERS Defendant to make its initial disclosure on March 17, 2023, and to process responsive documents at a rate of 500 pages per month. If Defendant wishes to file a supplement to the Joint Status Report providing specific reasons why that timetable is not feasible in this case, the Court will consider modifying this Order. The Parties will continue to file Joint Status Reports every ninety days in accordance with the Scheduling Order in this case. Signed by Judge Jia M. Cobb on February 16, 2023. 2023-03-01MINUTE ORDER. The Court GRANTS 16 Plaintiff's Motion for Leave to File Supplemental Status Report. Having considered the Joint Status Report, ECF 14 , the Supplemental Status Report, ECF 15 , and Plaintiff's Response, ECF 16-1, the Court will modify the production schedule as follows. 2023-05-1618Joint STATUS REPORT by TERRORIST SCREENING CENTER. (Curteman, Dedra) (Entered: 05/16/2023)
2023-05-23MINUTE ORDER re 18 Joint Status Report: The Court has reviewed the Joint Status Report. In the Report, Plaintiff requests an order "instructing the [Terrorist Screening Center], not the FBI, to come into compliance with all requirements of FOIA, including publicly publishing rules for processing and handling FOIA requests" and requiring both agencies to issue "separate and distinct declarations... identifying which agency responds to the requests made to this lawsuit via its production." Based on the representations made by the Parties, the Court does not see good cause to intervene at this time. The relationship between the agencies is a matter of public record. To the extent Plaintiff is challenging the adequacy of the search (and if that dissatisfaction cannot be resolved by conferring in good faith with the agency), Plaintiff is free to make that argument in a dispositive motion, when such motions are filed. The Court further finds that it is not necessary to require the Parties to file their next report on an accelerated schedule, as requested by Plaintiff. The Parties are therefore ORDERED to submit their next Joint Status Report by July 17, 2023. Should any issues arise in the interim that require the Court's attention, the Parties may file a motion or request a status hearing. Signed by Judge Jia M. Cobb on May 23, 2023. (lcjmc3) (Entered: 05/23/2023)

2023-08-2420Consent MOTION to Consolidate Cases by TERRORIST SCREENING CENTER. (Attachments: # 1 Text of Proposed Order)(Curteman, Dedra) (Entered: 08/24/2023)
2023-08-25MINUTE ORDER re 20 Consent Motion to Consolidate Cases: The Court has reviewed the Parties' joint request. The Court finds that cases Nos. 22-cv-3178 and 23-cv-1573 implicate common legal issues and authorities; involve substantially similar facts, claims, allegations, defenses, and procedural postures; that consolidation would not prejudice the Parties; and that judicial resources would be conserved by consolidating the cases. Terrorist Screening Center , No. 22-cv-3178 (JMC) (D.D.C), and Constitutional Law Center for Muslims in America v. Federal Bureau of Investigation , No. 23-cv-1573 (JMC) (D.D.C.) are CONSOLIDATED.
