Defendant states that their deadline to respond is currently March 13, 2023 but that "the assignment of the case has been delayed and undersigned counsel has only recently been assigned." Because of this and due to heavy caseload, Defendant "requires a reasonable period of additional time to discuss this matter with the relevant agency, explore whether this case may be resolved without litigation." This is Defendant's first request for an extension and Plaintiff consents. The Court notes that Defendant is in violation of the 3 Standing Order, which states that "[m]otions for extensions of time must be filed at least four (4) business days prior to the first affected deadline."
