FOIA Project Annotation: Judge Trevor McFadden has ruled that the CIA properly responded to a multi-part request from Dale Adams for records concerning what the agency had collected about him. The agency acknowledged receipt of the request and a year later sent an estimated completion date. Adams filed suit. The agency provided interim responses, disclosing 26 documents with redactions. The agency also issued a Glomar response neither confirming nor denying the existence of records for eight of Adams' requests. Adams claimed that the agency had not conducted an adequate search. McFadden concluded that it had, noting that "the CIA's declaration details the scope of its searches. The CIA's main declarant describes the systems searched, why the relevant information is likely in those systems, and the personnel involved. The declarant also describes the search methodology â€" including the search terms and the date range â€" for each of Adams' requests." McFadden then noted that "Adams must show a reason to doubt the good-faith presumption afforded to this declaration. He does not. Instead, he argues the search was inadequate because the CIA did not produce certain records. But that is not the standard." He added that "Adams' speculation about missing documents presents no issue of material fact." Although he agreed that the Glomar response was appropriate for several portions of the request, he noted that "the CIA attested that it searched for records responsive to [four of the requests]. And it confirmed that it possessed responsive documents. So the CIA has acknowledged the 'fact' of those records' existence." He concluded that "thus, the CIA is entitled to summary judgment only as to [two items] for its Glomar response."

To merit reconsideration under Federal Rule of Civil Procedure (FRCP) 59(e), Adams must show "an intervening change of controlling law, the availability of new evidence, or the need to correct a clear error or prevent manifest injustice." Trudel v. SunTrust Bank, 924 F.3d 1281, 1287 (D.C. Cir. 2019) (cleaned up). Alternatively, FRCP 60(b) lists five grounds for reconsideration, including mistake, newly discovered evidence, fraud, or any reason that justifies relief. Adams' motion meets none of these standards. He claims, as before, that "someone" is deleting his files. He claims he took time to file a DC Bar complaint rather than working on his briefing. He cites his bad health, but he did not object to this schedule when it was proposed and cites no new health concerns that have arisen since the Court ordered the briefing schedule.
