FOIA Project Annotation: A federal court in Missouri has dismissed part of Jack Jordan's FOIA suit against the Department of Labor after finding it was duplicative of litigation Jordan brought in the D.C. Circuit. Jordan brought suit in Missouri contending the agency had failed to respond to two FOIA requests he had submitted. The first FOIA request was for letters concerning Jordan's allegations of misconduct by administrative law judges that heard his case. The second FOIA request asked for emails sent by DynCorp International that were in the possession of DOL's Benefits Review Board. The agency asked the court to dismiss the second request because it was duplicative of litigation Jordan had brought in the D.C. Circuit. In that case, Judge Rudolph Contreras had found that an email sent by DynCorp to its attorney was privileged under Exemption 4 (confidential business information). Contreras' decision was upheld by the D.C. Circuit. The federal court in Missouri agreed that the current litigation was duplicative, noting that "Plaintiff seeks to relitigate whether Defendant properly redacted the [disputed] email, asserting arguments he did or could have made before the D.C. District Court." Dismissing Jordan's second FOIA request, the court observed that "the conservation of judicial resources, comprehensive disposition of litigation, and the progress of that action weigh in favor of this Court deferring to the D.C. District Court. Plaintiff does not contend, much less set forth evidence, his rights were not adequately protected in the D.C. District Court lawsuit."

FOIA Project Annotation: A federal court in Missouri has ruled that Jack Jordan's request that the court overturn a previous ruling against him in the U.S. District Court for the District of Columbia pertaining to his FOIA requests to the Department of Labor should be denied. Jordan submitted two FOIA requests to the Department of Labor �" one for letters sent by the Office of the Administrative Law Judges to Jordan and the other for emails sent by employees of DynCorp International with the subject line "WPS �" next steps & action.'" DOL asked the court to dismiss the case, arguing it was duplicative of litigation Jordan brought in U.S. district court in Washington, D.C. in which Judge Rudolph Contreras ruled in favor of the agency. The court agreed with the agency that Jordan's suit should be dismissed. The court noted that "plaintiff has not demonstrated he did not have a fair opportunity to argue the issues in the D.C. District Court, or this Court, and he has not shown that granting his motions is necessary to correct a significant error."

FOIA Project Annotation: A federal court in Missouri has ruled that the Department of Labor properly responded to Jack Jordan's request for a copy of an administrative judge's decision by providing a PDF containing a scanned copy of the decision. Jordan requested the decision as an "unlocked PDF." The agency referred him to the PDF file on its website, which was publicly available and not password protected. Jordan challenged that decision and subsequently characterized the term "unlocked PDF" as being a record created either by Microsoft Word or a non-scanned PDF that was not password protected. The court pointed out that "even when liberally construing his FOIA request, the DOL could not have known Plaintiff sought the type of PDF format he later detailed. Furthermore, Plaintiff cannot expand his FOIA request and/or modify the requested format when appealing the DOL's denial or in his lawsuit when he did not request this more particular PDF format in his initial FOIA request." Jordan also argued that his request for copies of signed letters included drafts as well. But the court observed that "while the draft letters in Word were not sent to Plaintiff in response to his FOIA request, the final, signed copies of the letters were sent to Plaintiff. The DOL did not violate the FOIA when it sent Plaintiff the responsive letters in PDF format, which was one of the [two] formats requested by him and was also the format in which the DOL maintained the letters sent to Plaintiff."

FOIA Project Annotation: A federal court in Missouri has once again rejected Jack Jordan's multiple attempts to re-challenge the court's previous ruling dismissing his suit, which was itself based on Jordan's challenge of an adverse ruling he received the previous year in virtually identical FOIA litigation in the D.C. Circuit district court. Jordan, who was representing his wife in a Defense Base Act action, had requested emails sent by two employees of a defense contractor that became part of the record considered by an administrative law judge at the Department of Labor. In the first ruling in Jordan's case, Judge Rudolph Contreras found that while one of the emails was not privileged the other one was protected by the attorney-client privilege. Contreras' decision was summarily affirmed by the D.C. Circuit. Jordan then filed suit in the Western District of Missouri asking the court to disclose the emails. The court rejected Jordan's request, finding that the issues had already been litigated in the D.C. Circuit district court. This time, Jordan came back with multiple claims that the government had violated various rules and that the records should be disclosed. Rejecting all of Jordan's claims, the court noted that "other than Judge Contreras's recent decision, Plaintiff's latest Rule 60 motion is similar, if not identical, to his previous Rule 60 motion. The Court has already addressed those arguments. Plaintiff's additional arguments related to the recent decision by Judge Contreras does not change the Court's analysis and does not provide a basis for granting Plaintiff's relief pursuant to Rule 60."
