FOIA Project Annotation: A federal court in Utah has found that the Integrity Committee, which had investigated charges brought against the Justice Department's Inspector General, properly withheld records under Exemption 5 (deliberative process privilege), Exemption 6 (invasion of privacy) and Exemption 7(C) (invasion of privacy concerning law enforcement records). The district court had originally accepted the Committee's claim that all the records were protected by Exemption 7(A) (interference with ongoing investigation or proceedings), but the Tenth Circuit had sent the case back on remand after the investigation had been closed. The court, relying on the Ninth Circuit's functional test in National Wildlife Federation v. U.S. Forest Service, 861 F.2d 114 (9th Cir. 1988), for analyzing deliberative process claims, found that both opinion and factual material were protected because disclosure could reveal elements of the deliberative process itself. Expanding the "candid and frank" argument to fact as well as advice, the court noted that "if the author of a document knows that parts of the document may or may not be disclosed to the public depending on how the author parses his words, that [ ] would undermine the quality of the author's response and would frustrate the purpose behind exemption 5." The court added that "even if this approach is legally incorrect, the Court finds that in this case it cannot segregate the 'factual' material from the 'deliberative' materials contained in [the record] because they are inextricably intertwined." The court then applied the "core purpose" holding from Reporters Committee to deliberative process material, pointing out that "the specific documents in question would not contribute in any significant degree to the public's understanding of either the operations or activities of the government." The court allowed redactions of personal information under both Exemption 6 and 7(C). The court observed that "it is difficult to see how the names of those individuals who have been accused of misconduct will enhance the public's understanding of the activities of the [Committee]. Comparing this minimal public interest to the substantial privacy interest involved, the Court finds that [this] class of information is properly withheld under exemption 7(C)."
