FOIA Project Annotation: Judge Royce Lamberth has ruled that the Justice Department's Tax Division conducted an adequate search for records pertaining to an IRS investigation of Timothy Demitri Brown for money laundering or drug conspiracy. The Tax Division used its TaxDoc database to search under Timothy Brown and his Social Security Number. While the search found no criminal cases, two civil cases were located under Timothy Brown that appeared to be potentially responsive. However, further research showed neither case pertained to the requester. Brown argued that the agency should have searched under the name of the IRS agent. But Lamberth noted that "FOIA requires agencies to search only 'agency records' within the meaning of the statute and does not impose an obligation to search the records of another agency. The Tax Division and the IRS are not housed in the same agency. . .The Tax Division therefore would not have access to search the office or personal files of any IRS employees, nor is the Tax Division obligated to do so under FOIA." Brown also argued that the IRS agent's name should have been searched in the TaxDoc database. Lamberth pointed out that the agency had searched under the agent's name in the database and found no responsive records. He observed that "the Tax Division's search was therefore reasonable, even without conducting its search in the manner that plaintiff suggests it should have." He added that "moreover, an agency need not disclose records to a FOIA requester that it has reviewed in the process of conducting its search and determined to be non-responsive."
