PlaintiffAMERICAN OVERSIGHT
Case DescriptionAmerican Oversight submitted two FOIA requests to the Department of the Treasury. The first request asked for ecords concerning communications with the House Financial Services Committee on proposed legislation or administrative actions. The other request asked for records concerning Rep. Jeb Hensarling's comments that agency records provided to his committee should be considered congressional records, not agency records. American Oversight asked for expedited processing for the first request, which was granted by the agency. However, after hearing nothing further about either request, American Oversight filed suit.

2018-05-21MINUTE ORDER: The Court has received Defendant's 14 Consent Motion for Extension of Time to File Motion for Summary Judgment. Defendant is evaluating whether it can release additional information in response to Plaintiff's recent narrowing of the scope of challenged withholdings. Because this process may further limit the issues in dispute, or obviate the need for briefing, Defendant seeks a two-week extension in the deadline for its Motion for Summary Judgment, and in turn for subsequent briefing deadlines in the 13 Scheduling and Procedures Order. With Plaintiff's consent and notwithstanding the acknowledged tardiness of the extension request, the Court GRANTS Defendant's 14 Consent Motion for good cause shown. The Court shall adopt the parties' proposed summary judgment briefing schedule in its accompanying Amended Scheduling and Procedures Order. Signed by Judge Colleen Kollar-Kotelly on May 21, 2018. (lcckk1) (Entered: 05/21/2018)

2018-06-08MINUTE ORDER: The Court has received the parties' 16 Joint Status Report, which indicates that Defendant made discretionary releases in full of most of the challenged documents at issue and that Plaintiff does not intend to challenge the remaining withholdings. Accordingly, with the parties' consent, the Court shall VACATE the summary judgment briefing schedule established by the Court's 15 Amended Scheduling and Procedures Order. The parties shall file a further Joint Status Report by JULY 6, 2018 , indicating whether Plaintiff has in fact decided to pursue attorneys' fees and costs, identifying the status of any negotiation of a resolution of any such request, and proposing a briefing schedule, if necessary.
