Case DescriptionMake the Road New York and Make the Road Connecticut, community organizations working with immigrants, submitted FOIA requests to the Department of Homeland Security and the Department of Justice for records concerning the Trump administration's decision to terminate DACA. The two organizations also requested expedited processing and a fee waiver. The agencies acknowledged receipt of the requests. DOJ's Office of Legal Counsel denied the request for expedited processing. The organizations filed an administrative appeal of that decision, but the agency upheld its original decision to deny expedited processing. The organizations also agreed with OLC to narrow their request to cover only records pertaining to legal advice. After hearing nothing further from the agencies, Make the Road New York and Make the Road Connecticut filed suit.

DHS claims to have known about the records referred by United States Citizenship and Immigration Services since March 2019. (June 28, 2019 Mot. for Extension of Time (Dkt. 55) at 1.) However, DHS did not inform the court that these records might prevent DHS from complying with the court's deadlines until June 28. In fact, just two weeks ago, Defendants requested a deadline of July 2, 2019, to file motions for summary judgment and did not mention any delay in processing documents on the part of DHS. (June 18, 2019 Mot. for Extension of Time (Dkt. 53).) In its latest extension request, DHS offers no explanation for its failure to inform the court of this delay until June 28.
