Case DescriptionThe Campaign Legal Center submitted a FOIA request to the Department of Justice for records pertaining to a request from Arthur Gary, General Counsel of the Justice Management Division, to the Census Bureau asking it to add a citizenship question to the 2020 Census form. CLC also requested expedited processing. The agency acknowledged receipt of the request and granted CLC's request for expedited processing. After hearing nothing further from the agency, CLC filed suit.

2018-10-31MINUTE ORDER: Having considered the parties' Joint Status Report 11 and the updates provided at the October 31, 2018 Status Conference, the parties are ordered to adhere to the following deadlines. With respect to the FOIA requests made to the Justice Management Division, the 170 pages that were referred to the Office of Information Policy, the 40 pages that were referred to the Department of Commerce, and 5 pages that were referred to the Census Bureau shall be processed and produced on or before December 12, 2018. Further, the status report, due on or before December 17, 2018, shall include, but not necessarily be limited to, the following: (1) an update on the production due on or before December 12, 2018; (2) an update on whether the searches that are scheduled to be rerun in the next three months are duplicative of Plaintiff's requests; (3) an update on whether the fact that the instant request was granted expedited processing should result in it advancing in the queue; (4) a production schedule for the documents that are responsive to the requests made to the Office of the Attorney General; and (5) a proposed status conference date.
