Case DescriptionThe New York Times submitted FOIA requests to a number of components of the Department of Defense as well as the Office of the Director of National Intelligence for records pertaining to Appendix M of the Army Field Manual, which limits the use of torture in interrogation. The New York Times also requested a fee waiver. The agencies acknowledged receipt of the requests. After hearing nothing further from the agencies, the New York Times filed suit.

FOIA Project Annotation: A federal court in New York has ruled that U.S. CENTCOM must process records at a rate of 500 pages a month rather than the agency's proposed rate of 300 pages every 60 days. The New York Times submitted the FOIA requests in 2019 and filed suit several months later after the Defense Department failed to respond within the statutory time limit. Two years later, the parties were still disputing the rate at which CENTCOM should process the request, the Times arguing that the requests should be processed at a rate of 500 pages a month while CENTCOM wanted to a rate of 300 pages a month every 60 days. Judge Vernon Broderick indicated that CENTCOM had a FOIA backlog of 3,421 requests and that the number of requests had increased more than 500 percent in the last seven years. The FOIA requests had also become more complicated over time, including more classified information. The majority of CENTCOM's requests were considered complex and each complex request takes an average of 320 days to complete. Broderick observed that "while the difficulty of processing classified materials is certainly relevant, it cannot be dispositive." The Times argued that the number of new requests received by CENTCOM was decreasing, a decrease largely due to the COVID pandemic. The agency had increased its FOIA staffing, two of eight positions were currently unfilled, although CENTCOM was attempting to increase its staff. Weighing the competing interests, Broderick noted that "I find that a rate of 500 pages every 60 days should be practicable. This rate is within the range of release schedules at CENTCOM. While I acknowledge Defendants' limitations, I also recognize that this case has dragged on since October 2019. If FOIA is to be more than a dead letter, Defendants must act on Plaintiff's request with a greater degree of urgency."
