FOIA Project Annotation: A federal court in Maryland has ruled that the Department of Treasury and the Department of Veterans Affairs properly responded to multiple FOIAPA requests from pro se litigant Kiesha Lewis, a former employee of the IRS, covering a range of claims under both FOIA and the Privacy Act. The agencies argued that most of the complaints should be dismissed because Lewis had failed to exhaust her administrative remedies. The court found three instances in which Lewis had filed appeals but dismissed many of the others, noting that Lewis claimed the agencies failed to respond on time or provided unsatisfactory responses. The court pointed out that "such lengthy delays and unsatisfactory responses do not excuse the failure to exhaust. . .Once the agencies provided responses, even if unsatisfactory, Lewis was required to filed administrative appeals before filing suit." The court found the VA had failed to show that either Exemption 5 (privileges) or Exemption 6 (invasion of privacy) applied to documents pertaining to hiring. As to the Exemption 5 claim, the court noted that "where the VA has described the document in question as a memorandum relating to the appointment of the members of the Executive Resources Board for a particular hiring decision, it is unclear whether it contains similar material or whether it simply lists the appointed individuals, the dates of their meetings, or other such information. The VA has not provided legal authority establishing that Exemption 5 protects such non-consultative information from disclosure."

FOIA Project Annotation: A federal court in Maryland has ruled that the Department of Treasury and the Department of Veterans Affairs properly responded to FOIA/PA requests from Keisha Lewis, a former employee of the Department of Treasury. Lewis, a former employee of the IRS and the Bureau of Engraving and Printing, filed a 16-count complaint against Treasury, the IRS, the BEP, and the Treasury General for Tax Administration, as well as against the VA challenging actions taken or not taken in response to her various requests. The VA argued that her FOIA and Privacy Act requests were moot because the agency had responded to them. Judge Theodore Chuang noted that "where an agency 'produces the requested records,' a challenge to a particular denial of a FOIA request becomes moot.'" He added that "because the parties agree that the VA produced the relevant documents and no other merits-based relief is available to Lewis, the FOIA claim against the VA is moot." He then pointed out that "the same is true for Lewis's Privacy Act claim. Though the Privacy Act authorizes monetary damages for certain claims, [her PA claim against VA] is a claim based on the denial of access to records, under 5 U.S.C. § 552a(g)(1)(B) and damages are not available for claims under that provision. As a result, the Privacy Act claim in [her claim against the VA] is also moot. Lewis complained that the IRS failed to maintain her SF-50 with sufficient accuracy. As a result, Lewis contended that she lost the opportunity to apply for several jobs because she could not get her SF-50 in time. Dismissing the claim, Chuang noted that "although the IRS's failure to provide the SF-50 upon request was unfortunate and troubling, it did not constitute a violation of § 552a(g)(1)(C). First, a violation of that provision requires that the agency failed to maintain the record accurately, and that it failed to provide a copy upon request. Here, the record demonstrates that Lewis's SF-50 was timely and accurately generated on October 20, 2017 in accordance with IRS procedures, that Lewis eventually received a copy, and that she has not claimed it contains inaccurate information. Second, a violation requires that an agency's 'reliance on the inaccurate records was the proximate cause of the adverse determination,' but Lewis does not claim that DHS relied on any inaccuracy in the SF-50, only that she was not provided with a copy of the SF-50 in a timely manner and thus could not provide it to DHS." Lewis also contested the IRS's failure to allow her to participate in the Fresh Start Program, which would have allowed her to reduce her tax debt. Chuang pointed out that "although she argues that an IRS Notice of Intent to Levy effectively constituted an adverse determination, an intent to levy letter serves only as a notice of upcoming tax liability and is not itself a denial of an application under the Fresh Start Program or any other opportunity for tax relief."
