2021-08-16MINUTE ORDER denying the plaintiff's 41 Motion to Appoint Counsel. "The law is well established that there is no constitutional right to appointment of counsel in a civil case, and no indigent civil litigant is guaranteed counsel." Brown v. Children's Nat'l Med. Ctr., 773 F. Supp. 2d 125, 140 (D.D.C. 2011). In deciding whether to appoint counsel in a civil case, courts consider, among other factors, the "nature and complexity of the action" and "the potential merit of the pro se party's claims." LCvR 83.11(b)(3). Here, the plaintiff seeks counsel to "assist in a third attempt to submit a short and plain statement to conform to Rule 8(a)" of the Federal Rules of Civil Procedure. Pl.'s Mot. at 1, Dkt. 41. But compliance with that rule is fairly straightforward. Rule 8(a) requires a "short and plain statement of the grounds for the court's jurisdiction," a "short and plain statement of the claim showing that the pleader is entitled to relief," and a "demand for the relief sought." Fed. R. Civ. P. 8(a). Under that rule, if the plaintiff elects to file a Third Amended Complaint, he must clearly state any legal claims that he has against the defendants. And if the plaintiff raises FOIA claims, he must "allege facts that (1) clearly identify each FOIA request that is the subject of this action, including the agency or agency component to which the request was made, and (2) summarize each agencys response to the specific request, including whether records were withheld or denied." Order of May 26, 2021, at 3, Dkt. 38. Because complying with Rule 8 does not present "difficult legal issues," Poindexter v. FBI, 737 F.2d 1173, 1189 (D.C. Cir. 1984), and because the plaintiff has yet to show a meritorious claim, this Court finds that the appointment of counsel is unnecessary at this stage of the case. So Ordered by Judge Dabney L. Before the Court are the government's 56 Second Motion for Extension of Time and the plaintiff's 55 Motion to Add Needed Supplement to Request to Expedite, which the Court construes as a motion to expedite. The Court concludes that there is good cause for an extension because the operative complaint appears to challenge the government's response at least thirteen FOIA requests. In addition, although the plaintiff is correct that this case has been pending for some time, some of that delay is attributable to the plaintiff's delay in filing a pleading that comports with the Federal Rules of Civil Procedure. See 52 Order of February 15, 2022; 38 Order of May 26, 2021; 23 Order of October 6, 2020. Finally, the plaintiff has not provided good cause for expediting this matter over the other matters on this Court's docket. See Comm. on Ways & Means, U.S. House of Representatives v. U.S. Dep't of the Treasury, No. 1:19-CV-01974 (TNM), 2019 WL 4094563, at *1 (D.D.C. Aug. 29, 2019) (noting that "most plaintiffs want quick resolutions of their cases"). Instead, the majority of his motion consists of argument on the merits, which is premature on account of the fact that the government has yet to file its answer. For those reasons, the government's 56 Motion is GRANTED and the plaintiff's 55 Motion is DENIED. Accordingly, the government shall answer or otherwise respond to the plaintiff's 53 Third Amended Complaint on or before May 20, 2022. The motion makes arguments based on the content of released (and partially released) documents and references claims for compassionate release, habeas relief, Brady violations, and other issues related to the substance of his prior criminal case. Groenendal previously raised similar issues in his First and Second Amended Complaints, both of which the Court struck for failure to comply with Rule 8(a) of the Federal Rules of Civil Procedure. 2023-06-16MINUTE ORDER denying the plaintiff's 96 Motion to Appoint Counsel. "The law is well established that there is no constitutional right to appointment of counsel in a civil case, and no indigent civil litigant is guaranteed counsel." Brown v. Children's Nat'l Med. Ctr. , 773 F. Supp. 2d 125, 140 (D.D.C. 2011). In deciding whether to appoint counsel in a civil case, courts consider, among other factors, the "nature and complexity of the action" and "the potential merit of the pro se party's claims." LCvR 83.11(b)(3). Here, the plaintiff seeks counsel to "due to complexity of motion for discovery request" and to avoid "delay from the defendants [that] will render any motion moot[ed]" by his release from prison. Pl.'s Mot. at 1, Dkt. 96. But the plaintiff has already filed a 97 Motion for Discovery, which the Court will consider alongside the pending motions for summary judgment once briefing is complete. And the Court has repeatedly been cognizant of the plaintiff's concerns about delay, for instance, by ordering the defendants to file their response and reply brief on or before July 3, 2023 with no further extensions. See Minute Order of May 4, 2023. In addition, this appears to be a relatively straightforward FOIA case concerning the propriety of withholdings and adequacy of the search, see Minute Order of March 8, 2023, and at this time the litigation is not so complex that counsel is required. Nor has the Court yet had opportunity to evaluate the potential merit of the plaintiff's claims, as briefing has not yet concluded on the defendants' pending 92 Motion for Summary Judgment and the plaintiff's 95 Cross-Motion for Summary Judgment. Accordingly, appointment of counsel is not appropriate at this time. Finally, in light of the plaintiff's prolific filings over the course of this litigation and particularly in the last week, the plaintiff is admonished that continued lengthy filings will likely further delay resolution of his motion for summary judgment.
