2023-01-0425JUDGMENT: In accordance with the memorandum opinion entered today, it is the ORDER, JUDGMENT, and DECREE of the court that: (1) Plf's 23 objections are overruled; (2) The US Magistrate Judge's 22 recommendation is adopted to the extent set forth in the opinion entered today; (3) Dfts' 13 motion to dismiss plf's FOIA claim is granted; (4) Dfts' 13 motion for summary judgment is denied as moot; (5) Plf's 21 motion for leave to file an amended complaint is denied as futile; (6) To the extent plf pleaded a claim in the original 1 complaint based on the First Amendment right to petition the government, the claim is dismissed for the same reasons given in the opinion for denying the motion for leave to amend the complaint as futile because the claim is not cognizable under Bivens v. Six Unknown Named Agents of Fed. Bureau of Narcotics, 403 US 388 (1971); (7) This case is dismissed with prejudice; Costs are taxed against the plf, for which execution may issue. The clerk of the court is DIRECTED to enter this document on the civil docket as a final judgment pursuant to Rule 58 of the Federal Rules of Civil Procedure. This case is closed.
