Case DescriptionBuzzFeed Reporter Jason Leopold submitted a FOIA request to the Department of Homeland Security for records concerning plans for implementing the Trump rally that resulted in the storming of the Capitol building. Leopold also requested expedited processing. The agency components acknowledged receipt of the request. Some components granted Leopold's request for expedited processing while others did not. After hearing nothing further from the agencies, Leopold filed suit.

2023-03-06MINUTE ORDER denying without prejudice Plaintiffs' 29 Partial Motion for Summary Judgment. On March 2, 2021, Plaintiffs sued several government defendants under the Freedom of Information Act seeking records related to the January 6, 2021 attack on the U.S. Capitol. On August 22, 2022, Plaintiffs moved for partial summary judgment against the U.S. Secret Service only, claiming its search was inadequate. In short, Plaintiffs seek text messages from certain Secret Service officials related to January 6, which they have not received. Defendant opposes summary judgment, arguing that Plaintiffs' motion is premature. The Court agrees, and it will deny Plaintiffs' motion without prejudice. Consistent with this Court's general practices favoring efficient adjudication of FOIA cases, "summary judgment is not appropriately considered until defendant has filed its Vaughn declaration and index." Kooritzky v. McNary , No. 92-1270, 1993 WL 79519, at *1 (D.D.C. Mar. 11, 1993); see also Am. Oversight v. U.S. Dep't of Veterans Affairs , 326 F.R.D. 23, 30 (D.D.C. 2018). Although the Secret Service has finished producing documents, it has not produced a Vaughn index, without which it is impossible for Plaintiffs to advance any other claims it may have against the Secret Service, including any challenges to its withholdings. The Court declines to adjudicate piecemeal Plaintiffs' claims against this one defendant. It further notes that several other defendants in this case have finished their productions, yet Plaintiffs have neither moved for summary judgment nor stipulated dismissal as to these agencies, further underscoring the possible inefficiency in proceeding as Plaintiffs suggest. Therefore, it is hereby ORDERED that Plaintiffs' 29 Partial Motion for Summary Judgment is DENIED WITHOUT PREJUDICE. It is further ORDERED that, by April 6, 2023, all the parties shall file a joint status report proposing a schedule for further proceedings, including the date by which the Secret Service will produce its Vaughn index and a briefing schedule for cross-motions for summary judgment as to any claims against the Secret Service as well as any other defendants that have completed their productions to Plaintiffs.
