Case DescriptionLawrence Schnapf, an attorney and professor of law at New York University, submitted a FOIA request to the National Archives and Records Administration for records concerning two October 2017 letters sent to the Trump administration by NARA pertaining to the release of remaining records under the JFK Act. Schnapf also requested expedited processing. The agency acknowledged of the request. The agency denied Schnapf's request for expedited processing. Schnapf then filed suit.

2022-01-14MINUTE ORDER granting Plaintiff's 8 Consent Motion for Leave to File First Amended Complaint. Under Federal Rule of Civil Procedure 15(a)(2), courts "should freely give leave [to amend] when justice so requires." The factors for whether to grant leave to amend under Rule 15 include: "(1) undue delay; (2) prejudice to the opposing party; (3) futility of the amendment; (4) bad faith; and (5) whether the plaintiff has previously amended the complaint." Habliston v. FINRA Dispute Resolution, Inc. , 251 F. Supp. 3d 240, 244 (D.D.C. 2017). The Court finds that justice requires granting Plaintiff's Motion. Plaintiff has not previously amended his complaint and seeks to do so now solely in order to include a count to compel production of the same FOIA materials at issue in his existing count for expedited processing. Defendant consented to the Motion. Accordingly, it is hereby ORDERED that Plaintiff's motion is GRANTED. The Clerk is directed to docket ECF No. 8-2 as Plaintiff's First Amended Complaint.
