2011-08-02 | | MINUTE ORDER (paperless). Defendant filed its 18 Motion for Summary Judgment in this FOIA action on June 3, 2011. On August 1, 2011, Plaintiff filed a 20 document styled as both (a) an Opposition to Defendant's Motion for Summary Judgment and (b) a Cross-Motion for Summary Judgment on the Issue of Attorneys' Fees ("Cross-Motion"). In its Cross-Motion, Plaintiff contends that it is a "substantially prevailing party" under FOIA because Defendant has allegedly released the vast majority of documents covered by its requests. Plaintiff's Cross-Motion is in actuality just a petition for fees under 5 U.S.C. § 552(a)(4)(E)(i), which is a matter collateral to the merits. As such, Plaintiff's Cross-Motion is premature and is DENIED WITHOUT PREJUDICE with leave to re-file a petition for fees after the Court has resolved the merits in this case. See Cambell v. U.S. Dep't of Justice, 164 F.3d 20, 37 n.18 (D.C. Cir. 1998); Hussain v. U.S. Dep't of Homeland Sec., 674 F. Supp. 2d 260, 272-73 (D.D.C. 2009).
