Collins: On April 26, 2010, this Court issued an Order to Comply With Local Rule 3-2, which requires that all manually filed civil initiating documents be e-mailed in electronic form (PDF format only) within twenty-four hours of the date the civil initiating documents are filed. Plaintiffs counsel has failed to comply with that Order of Court. IT IS HEREBY ORDERED that counsel appear in person before Chief Judge AUDREY B. COLLINS, on July 26, 2010 at 10:00 a.m., Courtroom 680, Roybal Federal Building and United States Courthouse, 255 East Temple Street, Los Angeles, California, to show cause why monetary sanctions should not be imposed against counsel pursuant to Local Rule 83-7(a), for failure to comply with Local Rule 3-2. Counsel Gustavo Diaz has not complied with Local Rule 3-2 requirements and has not paid the $500.00 sanction the court has previously ordered. The Court ORDERS Gustavo Diaz to pay an additional personal sanction of $1,000 for not complying with Local Rule 3-2 requirements and not paying the $500.00 personal sanction previously ordered. A total of $1, 500.00 is due by Monday, August 23, 2010 at the Clerk's Office. The Court will notify the State Bar regarding this matter and the assigned District Judge Margaret M. Morrow. 2010-11-04 | 11 | MINUTE ORDER IN CHAMBERS Discharging Contempt Sanctions by Judge Audrey B. Collins: On April 26, 2010, this Court ordered Plaintiff Ricardo Miranda and his attorney, Gustavo Diaz, to comply with Local Rule 3-2 within twenty-four hours of issuance of that order. (Docket No. 5.) They failed to do so, so the Court issued an Order to Show Cause on June 8, 2010 why counsel should not be sanctioned for failing to comply. (Docket No. 6.) Counsel was ordered to respond by July 19, 2010, but he did not. On July 26, 2010, the Court issued sanctions in the amount of $500 and further ordered counsel to appear on August 9, 2010 or risk further sanctions. (Docket No. 7.) Once again, counsel did not comply, so the Court imposed additional sanctions of $1,000 and notified the California State Bar. (Docket No. 8.) Thereafter, Judge Morrow issued an Order to Show Cause why the case should not be dismissed for lack of prosecution. (Docket No. 9.) Plaintiff failed to respond and the case was dismissed on September 9, 2010. (Docket No. 10.) The Court's records reflect that, due to a computer error, Plaintiff's counsel did not receive notice via regular mail of the Courts order at docket entry number 7. Because counsel did not receive this notice and because this case has been dismissed, the Court will DISCHARGE the contempt sanctions and notify the California State Bar that the sanctions have been discharged. Counsel for Plaintiff is ADMONISHED to comply with Local Rule 3-2, and all other Local Rules, in any future cases filed in this Court. (bm) (Entered: 11/08/2010) |
