2010-04-279ORDER that the Clerk SHALL send Plaintiff an Initial Disclosures Form, USM 285 form and summons for the Defendant Berry. Plaintiff SHALL complete forms and return completed forms to the Clerk within 20 days of the entry date of this Order. Plaintiff is warned that failure to comply is a timely manner could result in the dismissal of the civil action. The Clerk SHALL resubmit action if the Plaintiff fails to comply. Upon receipt of the completed forms, the Clerk SHALL prepare and mail a service waiver package and notice of lawsuit for Defendant Berry. In the event the Defendant does not return the Waiver of Service form to the Clerk of Court within 35 days following the date the service waiver package was mailed, the Clerk SHALL prepare and transmit to the U.S. Marshal's office a service package for Defendant. Upon receipt the Marshal's Service SHALL serve Defendant. The executed waiver or completed USM 385 form shall be filed with the Clerk. The Plaintiff SHALL be required to serve upon defendant or defendant's counsel copies of all additional pleadings submitted to the Court. Plaintiff is also required to keep the Court and Defendant advised of Plaintiff's current address at all times during the pendency of this action.
