FOIA Project Annotation: Judge Reggie Walton has ruled that the Department of Labor conducted an adequate search for a 2001Application for Alien Employment Certification filed on behalf of Carol Ahanmisi. The agency searched the two databases most likely to have the record and found nothing. Ahanmisi argued that the search was inadequate because the agency had spent so little time conducting the database search. But Walton noted that "the time and reasonableness of a search depends less on the time it takes to conduct the search and more on the thoroughness with which it was conducted. Moreover, the results of a search are not determinative of whether the search was adequate." Ahanmisi also claimed the agency should have conducted a search of hard copy records at the National Archives after it could not find an electronic copy of the record. Walton responded that "the defendant was not compelled to search for a hard copy of the document in the Federal Records Center in the absence of any reasonable likelihood that it would be found there."
