The Court is in receipt of the parties' 15 Joint Status Report dated July 2, 2012, wherein the parties: (1) jointly represent that "the substantive issues regarding Plaintiff's underlying FOIA suit have been resolved"; and (2) propose a briefing schedule for Plaintiff's anticipated motion for attorneys' fees, a matter collateral to the merits. The Court is gratified that the parties were able to resolve the substantive issues in this case amicably. By no later than JULY 10, 2012, the parties shall file an appropriate stipulation of dismissal of Plaintiff's substantive claims. By no later than JULY 10, 2012, the parties shall also file a joint notice indicating whether all parties consent to the assignment of the remainder of this action, including Plaintiff's anticipated motion for attorneys' fees, to a magistrate judge for ALL PURPOSES, with any appeal to be taken directly to the United States Court of Appeals for the District of Columbia Circuit in the same manner as an appeal from any other judgment of the district court. The parties are strongly encouraged to consider this option, which may very well result in a more prompt resolution of what remains of their dispute, but they are free to withhold consent without adverse substantive consequences. In weighing their options, the parties are advised that, absent such consent, the Court presently intends to refer Plaintiff's anticipated motion for attorneys' fees to a magistrate judge for disposition under Local Civil Rule 72.2. Regardless of whether the parties consent, they shall adhere to the following briefing schedule: Plaintiff shall file its motion for attorneys' fees by no later than AUGUST 8, 2012; Defendant shall file its opposition by no later than SEPTEMBER 10, 2012; and Plaintiff shall file its reply by no later than SEPTEMBER 24, 2012.
