2012-04-12 | | TEXT ORDER to Clarify the 4 Decision and Order issued by Magistrate Judge Peebles on 3/23/12. This case is regarding plaintiff's claims that the defendants violated the Freedom of Information Act ("FOIA"). It is not an action where plaintiff is appealing from a final administrative decision regarding social security benefits. Therefore, the court did not require a General Order 18 to be issued in this matter and did not include such language in the Decision and Order issued on 3/23/12. However, due to a clerical error, summonses were incorrectly issued by the clerk upon the defendants indicating that their time to respond to the complaint is w/in 100 days after service is completed. A General Order 18 was also issued by the clerk in error. Defendants are advised that the requirements set forth in General Order 18 do not apply to this case and that their time to respond to the complaint is 60 days after service is completed.
