FOIA Project Annotation: A federal court in New York has ruled that Summary of Findings reports prepared by the Fraud Detection and National Security Unit at U.S. Citizenship and Immigration Services are protected by Exemption 5 (deliberative process privilege). Applications for immigration benefits are assigned to a CIS adjudicator. If the adjudicator suspects possible fraud, he or she refers the application to FDNS for investigation. The findings and recommendations of the FDNS investigator are memorialized in an SOF report and referred back to the CIS adjudicator for a decision. John Assadi, the attorney for several applicants, requested the SOFS pertaining to his clients. Agreeing with the agency, the magistrate judge noted that "the FDNS does not have decision-making authorityâ€"the decision to award immigration benefits lies with the CIS adjudicator, not [FDNS]. . .Thus, because the FDNS lacks decision-making authority, the SOFs are necessarily predecisional." The magistrate judge added that "the SOFs enable the CIS Adjudicator to consider all relevant facts when determining whether immigration benefits should be awarded. In light of the role an SOF has in the adjudication process, it is also deliberative and protected by the privilege." The magistrate found that there was no segregable information in the SOFs. He pointed out that "all facts within an SOF are selective and deliberative, and disclosure would shed light on an otherwise exempt evaluation process." The agency had also redacted personal information under Exemption 6 (invasion of privacy) and Exemption 7(C) (invasion of privacy concerning law enforcement records). Noting that FDNS investigators had a recognizable privacy interest, the magistrate judge indicated that "given [that FDNS investigators] are responsible for only investigating and creating documents that summarize and evaluate their findings, and the lack of decision-making authority afforded to them, disclosure of their names is not likely to shed light on how the CIS adjudicator conducts the government's business." Assadi argued that he had a right of access to his clients' information. The magistrate, however, disagreed. He pointed out that "Assadi's status as counsel of record to the individuals who are the subject of the SOFs does not promote the public's interest in disclosure. Moreover, [the Notice of Entry of Appearance as Attorney form used by CIS] explicitly states that it may not be used for purposes of FOIA requests."

FOIA Project Annotation: The court ruled that USCIS also conducted an adequate search for records requested by John Assadi pertaining to visa applications for his clients. In both cases, Assadi requested the court view the records in camera. His request was rejected by the court. Assadi argued that in camera review was appropriate because there were only a small number of records. But the magistrate judge noted that "this is not the only factor the court should consider. Assadi argues that CIS's affidavits are conclusory because, by the time of its motion, CIS had provided no affidavits and only a conclusory Vaughn index. . .[But] CIS has since provided a supplemental Vaughn index that is sufficiently detailed. Considering that courts may remedy a conclusory Vaughn index by ordering a supplemental Vaughn index, the Court finds that this factor does not point towards in camera review." The court then found the agency had properly withheld records under Exemption 5 (deliberative process privilege) and had adequately explained why no factual information could be segregated and released. The agency had also withheld information pertaining to background checks under Exemption 7(E) (investigative methods and techniques). The magistrate judge noted that "because the withheld records consist of background check information and are being used for the purpose of gathering information on applicants, the records qualify as 'records or information compiled for law enforcement purposes. The withheld records qualify as 'techniques and procedures' because they include instructions for agency staff on how to interact with applicants and gather information for law enforcement purposes."

FOIA Project Annotation: A federal court in New York has ruled that U.S. Citizenship and Immigration Services conducted an adequate search for records concerning possible fraud in visa applications filed by attorney John Assadi on behalf of clients in several countries and that it properly withheld records under Exemption 5 (privileges). After the agency had responded to Assadi's request, it uncovered the existence of more than 1,000 pages of emails involving a CIS attorney who had worked on Assadi's threat to sue the agency over a non-FOIA related matter. The agency also conducted another search when two other CIS attorneys' names showed up as having been copied on the emails. Assadi argued that the agency's search was inadequate because it took far too long. But the court noted that "although CIS's delay in conducting its searches was extensive, Plaintiff cites no case and the Court knows of no precedent suggesting that delay alone may serve as a basis for finding that the Government's search was inadequate. . . 'General criticism' and allegations of delay are insufficient to demonstrate that CIS acted in bad faith. . .Furthermore, each time CIS became aware of insufficiencies in its prior productions, it notified the Court and conducted additional searches." CIS withheld a number of records concerning Asadi's suits or threats to sue the State Department. Finding these records protected by Exemption 5, the court pointed out that "they are deliberative in that they are subjective documents which reflect the personal opinions of the attorneys rather than the policy of the agency, and are an integral part of the process by which DOS decisions about the Assadi actions were formulated."
