2013-07-1715IN CHAMBERS ORDER RE: Under Seal Pilot Program by Judge Percy Anderson: Judge Anderson is participating in the Central District of California's Pilot Project for the Electronic Submission and Filing of Under Seal Documents. The Pilot Project applies to both civil and criminal cases. Parties shall make every effort to limit the number and volume of under seal filings. In most circumstances, parties should seek to file under seal only the specific exhibits or documents for which there is a valid basis for filing under seal. When seeking the Court's approval for an under seal filing, the submitting party shall electronically file an Ex Parte Application to Seal and proposed Order through the Courts CM/ECF System pursuant to Local Rule 5-4. The Ex Parte Application and proposed Order shall not contain the information the party seeks to file under seal. The party seeking permission to file under seal shall submit to the Court's generic chambers e-mail address (pa_chambers@cacd.uscourts.gov) PDF versions of the Ex Parte Application, proposed Order, Declaration in Support of Ex Parte Application stating the reason for the under seal filing, and the document(s) and/or exhibit(s) the party seeks to file under seal. The party shall also submit a Word or WordPerfect version of the proposed Order to the generic chambers e-mail address. 2013-08-0216MINUTE ORDER IN CHAMBERS by Judge Percy Anderson: The Court has received the parties' joint 26(f) report and finds that a scheduling conference is not necessary. Dates set by the Court in this action are listed in the "Schedule of Trial and Pretrial Dates" attached to this order. The dates set by the Court are firm dates. Absent extraordinary circumstances, which must satisfy the requirements of Federal Rule of Civil Procedure 16(b) and be brought to the Courts attention in a timely manner, the Court will not modify these dates. The scheduling conference currently on calendar for August 5, 2013, at 10:30 a.m. is hereby vacated, and the matter taken off calendar. Defendants request that discovery be stayed until they have filed their motions for summary judgment. 2014-02-1442MINUTES (IN CHAMBERS) ORDER by Judge Percy Anderson: Before the Court are four Motions for Summary Judgment filed by the Defendants (Docket Nos. 27, 30, 32 and 34). Pursuant to Rule 78 of the Federal Rules of Civil Procedure and Local Rule 7-15, the Court finds that this matter is appropriate for decision without oral argument. The hearing calendared for February 24, 2014, is vacated, and the matter taken off calendar. Plaintiff seeks disclosure of the materials he sought pursuant to the Freedom of Information Act (FOIA). Under FOIA, an agencys decision to withhold information from a FOIA requester is subject to de novo review by the courts. 5 U.S.C. § 552(a)(4)(B). The agency has the burden to justify the nondisclosure of documents and establish that a particular document is exempt from disclosure. Defendants asserted that they intend to bring these documents to the summary judgment hearing, unless otherwise instructed to file them under seal. Since the Court finds that this matter is appropriate for decision without a hearing, the Court orders Defendants to file with the Court an electronic copy of the disputed documents in camera and under seal by February 21, 2014.
