Plaintiff's request for permission to file his Motion for Reconsideration is DENIED. The Clerk is DIRECTED to terminate Plaintiff's Motion for Reconsideration, ECF No. 327, on the docket of this case. This court DISMISSES Plaintiff's case, in its entirety. No further submissions in this matter will be accepted, except any notice of appeal of this court's ruling herein; any other submissions in this case by Plaintiff shall not be filed in this now closed case, but will be docketed by the Clerk as a submission. The court hereby IMPOSES the following system of pre-filing review upon Plaintiff: Plaintiff may not file any action in this judicial district, the Eastern District of Virginia, in which he seeks forma pauperis status, without pre-authorization from a United States District Judge of this court. If Plaintiff wishes to file an action, he must submit a proposed complaint and a copy of this Order to enable determination of whether leave will be granted for filing. Upon receipt of any proposed complaint or correspondence submitted by Plaintiff, the Clerk is DIRECTED to send the submission to a United States District Judge of this court for review. The reviewing judge must determine if the case could be meritorious, or if it is frivolous, vexatious or repetitive. If the reviewing judge determines that the submission should not be filed, it will be returned to Plaintiff unfiled and without any further order of the court. If the reviewing judge determines that the submission should be filed, it shall be processed in the same manner as any other action. If the court allows Plaintiff to proceed with an action, Plaintiff may be required to seek leave of court to file any motion within such action. Leave would be freely granted when the interests of justice so dictate. If Plaintiff is allowed to proceed with an action and it is later determined that the action was baseless, vexatious, or repetitive, Plaintiff will be subject to the possibility of sanctions, after an opportunity to show cause, as justice so dictates. The Clerk is DIRECTED to send a copy of this Pre- Filing Review and Final Dismissal Order to Plaintiff and to counsel for Defendants. Copies of Order sent as DIRECTED on 8.19.16.
