Case DescriptionSrivastava was granted a visa allowing him to go to school in the United States. He then went to work for First Tek Technologies, which filed a petition to change his immigration status, which was approved. But when Srivastava tried to extend his visa in 2012, U.S. Citizenship and Immigration Services ruled that he had submitted fraudulent financial documents with his student visa application, ultimately ruling that he was inadmissible and could no longer work in the U.S. He filed a FOIA request for his alien file. USCIS provided the file with redactions. Srivastava appealed and the agency sent his request back for a further search for responsive records. Srivastava then filed suit.
