Case Description | Jonathan Ashley, a reference librarian at the University of Virginia law school, requested a non-prosecution agreement between the U.S. Attorney's Office for the Southern District of Texas and ABC Professional Tree Services from the Executive Office for U.S. Attorneys and asked for expedited processing. The agency did not respond to Ashley's request for expedited processing, but denied his request in full, citing Exemption 4 (confidential business information), Exemption 7(C) (invasion of privacy concerning law enforcement records), and Exemption 7(D) (confidential sources). Ashley appealed the denial to the Office of Information Policy. OIP upheld EOUSA's denial, concluding that Exemption 7(D) did not apply, but added Exemption 7(A) (interference with ongoing investigation or proceedings) and Exemption 7(E) (investigative methods and techniques) as applicable exemptions.
