FOIA Project Annotation: Judge Randolph Moss has ruled that EOUSA has failed to show that it conducted an adequate search for three requests submitted by Christian Borda for records about grand juries that were convened in the District Court for the District of Columbia. Borda, a federal prisoner, filed suit alleging the EOUSA had not responded to his requests. The agency filed a motion for summary judgment and Borda responded by trying to amend his complaint. After Moss told Borda that he could not amend his complaint without first filing a motion to amend, Borda did so. Borda failed to respond to the agency's summary judgment motion and the agency failed to respond to Borda's motion to amend. Moss initially granted Borda's motion to amend, noting that "Plaintiff's apparent and reasonable belief that he was entitled to amendment as of right may constitute grounds for excusing Plaintiff's failure timely to file an opposition." Moss then went on to explain that EOUSA's motion for summary judgment was so far completely inadequate. The initial agency affidavit showed only that EOUSA had received one of Borda's requests. A supplemental affidavit from a paralegal in the U.S. Attorney's Office for the District of Columbia indicated that the grand juries Borda was asking about were convened by the Criminal Division and that EOUSA did not have any records. Moss pointed out that "without an additional declaration demonstrating that a search was conducted of records maintained by the Criminal Division, there is no evidentiary basis for the Court to conclude that EOUSA has searched 'all files likely to contain responsive records.' Because the EOUSA's evidence�"even taken as undisputed�"does not establish that it conducted a search that was reasonably calculated to discover the documents Plaintiff requested [in one of his request], EOUSA is not entitled to summary judgment as to that request."

FOIA Project Annotation: Judge Randolph Moss has ruled that Criminal Division of the Justice Department has not yet shown that it conducted an adequate search for records pertaining to grand jury proceedings and other records related to the conviction of Christian Borda on drug-trafficking charges. Further, while Moss found the agency had properly applied Exemption 7(D) (confidential sources) to withhold identifying information about four individuals who testified against Borda at trial, he concluded the agency had not yet justified why the exemption applied to the entire plea agreements. Borda submitted four FOIA requests to EOUSA, three of which asked for specific items, while the fourth requested records about the grand jury proceeding more broadly. The agency consolidated the requests and referred them to the Narcotics and Dangerous Drugs Section of the Criminal Division that had been responsible for prosecuting the case. The Criminal Division identified 70 boxes of materials, and searched the materials for responsive records. The agency withheld four plea agreements under Exemption 6 (invasion of privacy) and Exemption 7(C) (invasion of privacy concerning law enforcement records) as well as Exemption 7(D). Moss initially found that the agency's decision to consolidate the requests had improperly narrowed the scope of the search. He indicated that "the Department may be correct that its search for some grand jury documents would have uncovered all responsive grand jury documents, but at this point, it has not demonstrated as much 'beyond material doubt.'" Borda argued that the plea agreements were not subject to Exemption 7(D) because the government had waived confidentiality through the individuals' public testimony at his trial. Moss, however, disagreed, noting that in Parker v. Dept of Justice, 934 F.2d 375 (D.C. Cir. 1991), the D.C. Circuit had adopted the First Circuit's conclusion in Irons v. FBI, 880 F.2d 1446 (1st Cir. 1989), that public testimony did not waive the agency's ability to claim Exemption 7(D). Applying the ruling here, Moss noted that "Borda offers no basis for the Court to stray from Parker's holding. To the extent any of the individuals identified in the plea agreements provided public testimony, doing so did not waive the Department's ability to invoke Exemption 7(D) to shield disclosure of their identities." But Moss found the agency had failed to show why all four plea agreements could be entirely withheld under Exemption 7(D). Moss observed that "the Department makes no attempt to explain why the remaining paragraphs should be withheld, nor is an explanation evident to the Court. It is unlikely, for example, that an entire plea agreement�"including the type of boilerplate terms commonly included in plea agreements�"represents information identifying or furnished by a confidential source." He added that "the Department may be correct that none of the four plea agreements is reasonably segregable, but the Court needs more information before determining whether the Department has done all that it can."

FOIA Project Annotation: Judge Randolph Moss has resolved the remaining issues in a case brought by prisoner Christian Borda for records about grand jury proceedings in the District of Columbia, as well as records concerning his 2010 conviction on conspiracy to commit a narcotics offense, ruling that the Department of Justice has now shown that it conducted an adequate search and that four plea agreements the FBI withheld because they were sealed remained properly sealed. Borda had filed suit in 2014 and his motion to amend his complaint had been pending for more than sixteen months, largely because he had failed to pursue his suit. Under the circumstances, Moss ruled that Borda's motion to amend should be dismissed. He noted that "the delay here, moreover, is substantial. Forty-two months elapsed from when Borda filed this suit to when he sought leave to amend the complaint for a second time to add substantial, new allegations, and he could easily have sought leave to amend long before he did so." In an earlier decision, Moss found that the FBI had not substantiated whether or not the four plea agreements it withheld because they were sealed were still subject to a sealing order. Finding that all four plea agreements were still subject to the sealing order, Moss agreed the FBI had properly withheld them. Moss also found that several documents had been properly withheld under Exemption 3 (other statutes), citing Rule 6(e) on grand jury secrecy, but that although other documents did not qualify for Rule 6(e) protection they were properly withheld under Exemption 5 (privileges).
