Case DescriptionAccuracy in Media and a number of retired military officers submitted 17 FOIA requests to multiple agencies for records pertaining to the attack on the U.S. consulate in Benghazi. The requests also asked for expedited processing, inclusion in the media category, and a public interest fee waiver. While some agencies failed to respond further, several agencies denied expedited processing and the State Department asked Accuracy in Media to narrow its request, which it did. After exhausting administrative remedies with all the agencies, Accuracy in Media filed suit.

FOIA Project Annotation: Judge Emmet Sullivan has affirmed Magistrate Judge Deborah Robinson's recommendation that the Department of Defense, the Department of State, the FBI, and the CIA properly responded to 40 requests from Accuracy in Media about the 2012 attack on the United States Embassy in Benghazi, Libya. AIM requested maps from the Defense Intelligence Agency depicting all assets within 1500 miles of Benghazi on September 11 and 12, 2021, DOD assets, pre-positioned off the coast of Libya on October 18, 2011, and threats to U.S. personnel because of al-Qaeda. DIA conducted two searches of its Record Message Traffic database, located 148 pages of responsive records, referred 92 records to other agencies, and determined that it would withhold 25 records in part and 30 records in full. AIM sent requests to the Navy, the Marine Corps, and European Command for orders to NAVSTA Rota personnel to get ready to deploy. These DOD units searched for records. DOD located 12 pages of maps responsive to the requests, but decided to withhold them. The CIA found some Inspector General records that were responsive, while the FBI never made any of records requested from it public. Sullivan referred the case to a magistrate judge and Robinson was assigned randomly. Robinson sided with the agencies except for the FBI's Glomar response neither confirming nor denying the existence of records. AIM argued that Robinson had failed to consider DOD's misrepresentation regarding the timing of the order transmitted on September 11 and 12, 2012 after the attack on Benghazi. They cited testimony by former DOD Secretary Leon Panetta has given to the House Select Committee that the first order following the attack was transmitted at 8:39 pm, which conflicted with evidence DOD earlier produced that the time was 3:00 am. Sullivan, noted that "plaintiffs' objection fails because the evidence they cite is entirely consistent with DOD's representation," which indicated the Panetta gave a verbal order at 8:39 pm and that the first written order was not produced until 3:00 am the next day. Sullivan explained that "the evidence from both parties supports DOD's claim that the order issued at 8:39 pm was a verbal order. Plaintiffs have not offered any evidence that this order was also reduced to writing that could have been produced here, and indeed, the evidence suggests that it never was." AIM also argued that maps were improperly classified because their disclosure would not cause harm to national security. Sullivan indicated that AIM's claim was based on the opinion of a retired Admiral and could not outweigh the expert testimony of DOD. Sullivan also rejected AIM's claim that a map from the Congressional Research Service that became part of the Congressional record showed the same information as the classified maps. Instead, Sullivan explained that "the CRS map shows only the distances between Benghazi and other locations in the Mediterranean region." He added that "neither map details all of the information Plaintiffs asked for in their FOIA requests, such as the official positions of the military assets or the types of assets at those locations."

The plaintiff in this case has filed a series of motions that are, in the Court's view premature and unnecessarily piecemeal. The parties submitted 20 a proposed schedule for the production of documents in this case, but the plaintiff proceeded almost immediately to file motions for partial summary judgment on narrow issues. The plaintiff, however, chose to file this case as one civil action and it will proceed as such. First, the Court GRANTS 18 the Department of Justice's unopposed motion for an Order permitting it to move for summary judgment based on the applicability of Exemption 7(A) to certain records without waiving any allegation that those records are exempt from release for other reasons. Second, the Court grants 19 plaintiff's motion to stay the portions of its claim against the Central Intelligence Agency that, in plaintiff's view, will become ripe only upon issuance of a Report by the House Select Committee. The Court finds that judicial economy would not be served by excluding these claims entirely from this case, only to reopen them at some later date. Third, in accordance with 24 the parties' stipulation, plaintiff's 23 first motion for partial summary judgment was WITHDRAWN and is therefore DENIED. Fourth, plaintiff's 27 unopposed motion for leave to file a Second Amended Complaint is hereby GRANTED. Plaintiff's Second Amended Complaint, Exhibit 1 to 27 its motion for leave, shall be filed on the docket as a separate docket entry. Defendants shall respond to the Second Amended Complaint in accordance with the Federal Rules of Civil Procedure. In view of the filing of a Second Amended Complaint and the fact that the plaintiff has sought repeatedly to file piecemeal motions for partial summary judgment, the Court DENIES WITHOUT PREJUDICE 25 plaintiff's second motion for partial summary judgment. The plaintiff chose to file this case against a number of defendants and including a number of potential legal and factual issues, and to file it in a single case. The Court intends to treat the case as such, with the exception of the claims against the CIA that have been stayed by this Order. Accordingly, neither party shall move for summary judgment on a piecemeal basis without obtaining leave of this Court and demonstrating good cause for proceeding in that manner. The parties are directed to confer and file a joint status report setting forth the following information: (1) the current status of the House Select Committee's Report and any indication of when that Report may be issued, and therefore when plaintiff's stayed claims may be reopened; (2) the parties' competing proposals for a schedule for the completion of any production of any further records by each of the defendant agencies; and (3) the parties' suggestions for an appropriate schedule--to commence after every defendant has completed its production schedule--for the briefing of a single round of cross motions for summary judgment. If the parties cannot agree on any of these issues, they shall include their individual perspectives in a joint status report. The joint status report shall be filed by no later than July 3, 2015.
